    On
    July 9,
    2009, the Board received
    a rulemaking
    proposal from the
    Illinois
    Environmental
    Protection Agency
    (Agency). Generally,
    the Agency
    proposes to
    adopt air
    pollution regulations
    to control
    emissions
    of volatile
    organic material
    (VOM)’ for Group
    II
    Consumer
    &
    Commercial Products
    in ozone
    nonattainment
    areas classified
    as
    moderate and
    above. Group
    II products
    include
    industrial cleaning
    solvents,
    flat
    wood paneling coatings,
    flexible
    packaging printing
    materials, lithographic
    printing
    materials,
    and letterpress
    printing
    materials.
    In an order
    dated
    August
    6,
    2009,
    the Board accepted
    the
    proposal
    for
    hearing
    and
    directed
    the hearing officer
    to
    take any necessary
    steps to avoid
    delay in scheduling
    the required
    hearings
    and completing
    the
    record.
    The
    Board will
    conduct
    two hearings
    in order to allow the
    proponent
    and
    any
    other
    interested
    participants the
    opportunity to present
    testimony
    on
    the merits and
    economic impact
    of
    the rulemaking
    proposal.
    At
    hearing,
    all persons
    who testify will
    be sworn in
    and
    subject
    to
    questioning.
    The Board
    will
    also
    receive
    any testimony
    on any
    economic impact
    study (EcIS)
    conducted
    by the Department
    of
    Commerce and Economic
    Opportunity
    (DCEO)
    on
    the
    proposed
    rules or on DCEO’s
    decision
    not to perform an
    EcIS.
    In setting hearing
    dates,
    the Board has considered
    and
    accommodated its general
    workload
    and
    hearings
    now scheduled. As
    indicated above
    in the notice of hearings,
    the
    first
    hearing
    will begin
    on Tuesday, October
    27,
    2009, and, if business
    remains
    at the end
    of the
    hearing on that day, will
    continue
    on Wednesday,
    October
    28, 2009. The
    second
    hearing will
    begin Tuesday, December
    8, 2009,
    and,
    if business
    remains at the end of
    the hearing on that day,
    will continue
    on Wednesday, December
    9, 2009.
