ORDER OF THE BOARD (by G.T. Girard):
On June 9, 2009, the 2001 Oil Company filed an appeal of an April 29, 2009 decision by
the Illinois Environmental Protection Agency partially denying 2001 Oil’s request for
reimbursement from the Underground Storage Tank (UST) Fund concerning a leaking UST site
located at 8001 West Golf Road in Niles, Cook County..

Ill. Adm. Code 105.206(a). On June 18, 2009 the Board accepted the petition as timely filed;
however, the petition contained certain deficiencies, which needed to be addressed before the
Board could accept the matter for hearing. The Board directed 2001 Oil Company to file an
amended petition by June 3, 2007, and stated that failure to do so will subject this appeal to
dismissal. On July 23, 2009, 2001 Oil Company filed a request to voluntarily withdraw its
petition. The Board grants the motion and therefore dismisses the petition and closes the docket.
IT IS SO ORDERED.
I, John T. Therriault, Assistant Clerk of the Illinois Pollution Control Board, certify that
the Board adopted the above order on August 6, 2009, by a vote of 5-0.
