POST-HEARING AMICUS BRIEF OF INTERVENOR,
VILLAGE OF PLAINFIELD
NOW COMES the Village of Plainfield (“Plainfield”), by and through its attorneys,
MCKEOWN, FITZGERALD, ZOLLNER, BUCK, HUTCHINSON & RUTTLE, and for its
Amicus Brief, respectfully states and submits as follows:
On December 6, 2007, the Village of Plainfield’s Motion for Leave to File an Amicus
Curiae Brief was granted due to the Plainfield’s participation in the landfill siting proceeding
before the City of Yorkville in regard to the above captioned matter, including providing expert
testimony on the impact of truck traffic through the downtown of Plainfield heading to and from
the proposed landfill. This testimony specifically pertained to Criterion (vi). The City Council of
Yorkville found this criterion was not met and subsequently denied Fox Moraine’s application to
site a landfill, for this and other reasons. Plainfield strongly supports the denial of siting by the
City Council of Yorkville. In the interest of judicial economy, the Village of Plainfield would
hereby join and adopt the
Post-Hearing Brief of Respondent, The United City of Yorkville
,
particularly sections III.-E. and III.- H.
