HEARING REPORT
On June 23, 2009, a hearing in this matter was held at City Hall in Litchfield,
Montgomery County. Attorneys Amy Antoniolli and Gabriel Rodriguez appeared on
behalf of the petitioner. Attorneys Deborah Williams and Joey Logan-Wilkey appeared
on behalf of the respondent.
Witness Credibility
4 witnesses testified during the hearing:
Mr. James Williams
Dr. James McLaren
Dr. Ann Shortelle
Mr. Michael Smallwood
All witnesses were found credible. Additionally, two members of the public
made comments at hearing.
Exhibits
Four exhibits were admitted at hearing. Petitioner offered Exhibits 1-3, consisting
of the prefiled testimony of Mr. Williams, Dr. McLaren, and Dr. Shortelle. Respondent
offered
Exhibit 4, entitled “Chapter 1. Overview of Results”. Neither party objected to the
admission of any exhibits.
Briefing Schedule
Petitioner agreed to pay for an expedited transcript due by June 26. At hearing,
petitioner agreed file additional documentation with the Board by July 10.

The parties are directed to participate in a telephone status conference on July 13
at
4:00 p.m. at which time a briefing schedule will be set. Petitioner shall initiate the call.
The public comment deadline is July 13, 2009.
