    On May
    19, 2009,
    Ameren
    Energy
    Generating
    Company (Ameren)
    filed a proposal
    for
    site-specific
    rulemaking
    pursuant
    to
    Sections 27 and
    28 of the Environmental
    Protection
    Act
    (415 ILCS 5/27, 28 (2006)),
    Section
    8 of the Illinois Groundwater
    Protection
    Act (415 ILCS
    55/8
    (2006)),
    and
    Sections 102.208 and
    102.210
    of the
    Board’s procedural
    rules
    (35
    Ill.
    Adm.
    Code 102.208, 102.2 10).
    Ameren
    proposes a new subchapter
    in
    the Board’s
    waste disposal
    regulations
    to address
    the
    closure of surface
    impoundments.
    Specifically,
    Ameren seeks the
    adoption of regulations
    through
    which
    it can close Ash Pond
    D
    at its
    Hutsonville Power Station
    near Hutsonville,
    Crawford County.
    In an order
    dated June 18, 2009,
    the Board, among
    other
    actions, accepted Ameren’s
    proposal for
    hearing and denied Ameren’s
    motion
    for expedited review.
    However,
    the Board
    directed
    the hearing officer to
    take any necessary
    steps to avoid delay
    in completing the
    record.
    After
    reviewing its schedule
    of hearings,
    the Board
    has identified the following
    as the
    earliest
    dates on which it can
    set hearing
    in Crawford County
    on this matter.
    On
    each of these
    dates, the Board intends
    to schedule the hearing
    to begin
    on the indicated
    Tuesday
    morning
    and
    to continue,
    if business remains
    at the
    end
    of the day, on the
    indicated
    Wednesday.

    and Wednesday,
    August 19, 2009
    Tuesday,
    September
    15 and Wednesday,
    September
    16, 2009
    Tuesday,

    22 and Wednesday,

    Participants are
    directed
    to determine the dates
    above on
    which they will not be
    available for hearing.
    Once they have
    done
    so, participants
    are directed
    to notify
    the
    hearing officer
    by 4:30 PM on Monday,
    June 29, 2009,
    at the e-mail
    address below, of
    the
    listed dates
    on which they
    are not available,
    or that
    they are available
    for all of them.
    The Board
    intends
    to issue a Notice
    of Hearing
    soon
    after receiving
    those
    notifications.
