OPINION AND ORDER OF THE BOARD (by T.E. Johnson):
The Board today issues its final opinion and order in these four consolidated
administrative citation cases, imposing civil penalties and assessing hearing costs. Each of the
four administrative citations, corresponding to dockets AC 06-39, AC 06-40, AC 06-41, and AC
07-25, was issued by the complainant, the City of Chicago Department of Environment (CDOE).
The site at issue in all four citations is located at 1601 E. 130th Street in Chicago, Cook County
and is designated with Site Code No. 0316485103.
In this final opinion, the Board will first summarize the findings of its March 19, 2009
interim opinion and order. The Board will then describe the hearing cost filings received
pursuant to the Board’s interim order, after which the Board will discuss and assess hearing
costs. The final opinion is followed by the Board’s final order.
SUMMARY OF FINDINGS OF INTERIM ORDER
On March 19, 2009, the Board issued an interim opinion and order, granting respondents’
motions to consolidate the four cases for purposes of decision, and then finding as follows:
1.
In AC 06-39, CDOE did not prove that respondent Speedy Gonzalez
Landscaping, Inc. (SGLI) violated Section 21(p)(1), (p)(2), (p)(3), (p)(4), or
(p)(7)(i) of the Environmental Protection Act (Act) (415 ILCS 5/21(p)(1), (p)(2),
(p)(3), (p)(4), (p)(7)(i) (2006)) on March 22, 2006.
2.
In AC 06-40, respondent Jose R. Gonzalez (Mr. Gonzalez) violated Sections
21(p)(1), (p)(2), (p)(3), and (p)(7)(i) of the Act (415 ILCS 5/21(p)(1), (p)(2),
(p)(3), (p)(7)(i) (2006)) on March 22, 2006, but CDOE did not prove that Mr.

Gonzalez violated Section 21(p)(4) of the Act (415 ILCS 5/21(p)(4) (2006)) on
that date.

In AC 06-41, respondent 1601-1759 East 130th Street, L.L.C. (130th LLC)
violated Sections 21(p)(1), (p)(2), (p)(3), and (p)(7)(i) of the Act (415 ILCS
5/21(p)(1), (p)(2), (p)(3), (p)(7)(i) (2006)) on March 22, 2006, but CDOE did not
prove that 130th LLC violated Section 21(p)(4) of the Act (415 ILCS 5/21(p)(4)
(2006)) on that date.
4.
In AC 07-25, the administrative citation against 130th LLC for alleged violations
of Sections 21(p)(1) and (p)(7)(i) of the Act (415 ILCS 5/21(p)(1), (p)(7)(i)
(2006)) on October 3, 2006, was improperly issued and must be dismissed.

Because no violations were found in AC 06-39 or AC 07-25, the Board held that SGLI is
not subject to civil penalties or hearing costs in AC 06-39 and that 130th LLC is not subject to
civil penalties or hearing costs in AC 07-25.

held:
Mr. Gonzalez (AC 06-40) and 130th LLC (AC 06-41) allowed the open dumping
of waste in a manner resulting in litter, scavenging, open burning, and the
deposition of general construction or demolition debris. Accordingly, Mr.
Gonzalez and 130th LLC violated Sections 21(p)(1), (p)(2), (p)(3), and (p)(7)(i)
of the Act on March 22, 2006. None of these violations resulted from
uncontrollable circumstances. Mr. Gonzalez and 130th LLC are therefore subject
to civil penalties and must pay the respective hearing costs of CDOE and the
Board, as discussed further below.
However, CDOE did not establish that Mr. Gonzalez (AC 06-40) or 130th
LLC (AC 06-41) caused or allowed the open dumping of waste in a manner
resulting in the deposition of waste in standing water. Therefore, CDOE failed to
prove that Mr. Gonzalez or 130th LLC violated Section 21(p)(4) of the Act on
March 22, 2006.

As set forth in the order below, the Board directs CDOE and the Clerk of
the Board to file hearing cost documentation for AC 06-40 and AC 06-41, to
which Mr. Gonzalez and 130th LLC may respectively respond. After the time
periods for the filings on hearing costs have run, the Board will issue a final
opinion and order imposing civil penalties and assessing appropriate hearing
costs.

HEARING COST FILINGS RECEIVED PURSUANT TO INTERIM ORDER
On March 31, 2009, the Clerk’s Office of the Board filed a statement of costs incurred by
the Board as a result of hearings on May 9 and May 17, 2007, in the four administrative citation
cases. The statement lists the Board’s costs, the entirety of which consists of “court reporting”
charges, as follows:

On April 15, 2009, CDOE filed a statement indicating that it will not seek hearing costs.
On May 11, 2009, Mr. Gonzalez and 130th LLC filed a “Response Challenging Claimed
Costs” (Resp.). These respondents state that the March 31, 2009 statement of costs incurred by
the Board delineates “costs for the hearings in AC 06-39, AC 06-40, AC 06-41 and AC 07-25”
without “indicating the specific documentation for the AC 06-40 and AC 06-41 hearings, most
likely because it would have been impossible to segregate testimony resulting in liability and
non-liability.” Resp. at 1-2.
Mr. Gonzalez and 130th LLC argue that there should be no liability for hearing costs
associated with AC 06-39 or AC 07-25 because no violations were established in those cases.
Resp. at 1-2. These respondents then assert:
Further, as the CDOE did not prove that Respondents Mr. Gonzalez or 1601-1759
East 130th Street, LLC., caused or allowed the open dumping of waste in standing
water, Respondents should not be responsible for hearing costs associated with
efforts related to those charges.
Id
. at 2.
According to Mr. Gonzalez and 130th LLC, to hold them:
responsible where certain allegations are found to be baseless amounts to a form
of extortion where the CDOE can charge[] baseless allegations and a Respondent
must either accede to all charges or become responsible for paying the costs of a
protracted hearing to challenge baseless allegations.

Mr. Gonzalez and 130th LLC conclude by requesting that the Board “decline to impose costs for
the hearings as there is no basis to accurately determine the costs for the AC 06-40 and AC 06-41
hearings.”
Id
. at 3.
Section 42(b)(4-5) of the Act provides in relevant part:
DISCUSSION

In an administrative citation action under Section 31.1 of this Act, any person
found to have violated any provision of subsection (p) of Section 21 of this Act
shall pay a civil penalty of $1,500 for each violation of each such provision, plus
any hearing costs incurred by the Board and the Agency . . . . 415 ILCS
5/42(b)(4-5) (2006) (emphasis added).
The Board held in its March 19, 2009 interim opinion and order that the Board would
assess no costs for the AC 06-39 hearing or the AC 07-25 hearing, as neither case resulted in any
violations. However, having found violations in AC 06-40 and AC 06-41, the Board ruled that
“Mr. Gonzalez (AC 06-40) and 130th LLC (AC 06-41) must pay the corresponding AC 06-40
and AC 06-41 hearing costs of CDOE and the Board” and that the Board’s “final opinion and
order will assess appropriate hearing costs.” Interim Order, slip op. at 34.
The Board agrees with Mr. Gonzalez and 130th LLC that the Clerk’s Office statement
does not delineate which Board hearing costs are attributable to AC 06-40 or AC 06-41. Though
the hearings for the four administrative citations were conducted separately, they were, with the
agreement of the parties, conducted consecutively to maximize efficiency. As the Board stated
in its interim order:

The AC 06-39 hearing was held on May 9, 2007, and resulted in a 219-page
transcript.
2.
The AC 06-40 hearing was held on May 9, 2007, and was continued on May 17,
2007, and resulted in three separately-paginated transcripts: one 15-pages long;
the next 135-pages long; and the third 140 pages in length.
3.
The AC 06-41 hearing was held on May 17, 2007, and resulted in a 313-page
transcript.
4.
The AC 07-25 hearing was held on May 17, 2007, and resulted in a 50-page
transcript. Interim Order

Accordingly, on the first of the two days of hearings, May 9, 2007, the AC 06-39 hearing
was initiated and completed, and then the AC 06-40 hearing was initiated but not completed. On
the second day of hearings, May 17, 2007, the AC 06-40 hearing resumed and was completed,
and then the AC 06-41 hearing was initiated and completed, after which the AC 07-25 hearing
was initiated and completed.
The Board has reviewed the court reporting invoices billed to the Board for the four
hearings that took place over May 9 and May 17, 2007. Four invoices were received (two for
May 9 and two for May 17), each with a total dollar amount corresponding to one of the
subtotals provided in the Clerk’s Office statement: (1) Invoice #4808 for May 9, 2007, totaling
$1332.70; (2) Invoice #5084 for May 9, 2007, totaling $764.25; (3) Invoice #4823 for May 17,
2007, totaling $850.00; and (4) Invoice #4926 for May 17, 2007, totaling $1,949.25. Each of the
four invoices provides a breakdown of court reporting charges (
e.g.
, reporter attendance, pages

of transcription, disk, delivery) and, where applicable, deductions for late delivery. The Board
directs the Clerk’s Office to put the invoices in the record.
By procedural rule, the Board, at the beginning of each fiscal year, places on its web site
“a per day breakdown of the Board’s costs for holding a hearing.” 35 Ill. Adm. Code 108.504.
As stated on the web page setting forth hearing costs for July 1, 2008 through June 30, 2009
(http://www.ipcb.state.il.us/ClerksOffice/hearingcosts.asp), the Board “only seeks
reimbursement of its court reporting charges.” For hearings held in the geographical area of
Illinois north of U.S. 36, currently-posted rates (below) have not changed since the May 9 and
May 17, 2007 hearings were held in Chicago, and are reflected in the invoices at issue:

Two of the four invoices here (Invoice #5084 and Invoice #4823) set forth charges only
for the AC 06-40 hearing. Each of the other two invoices, however, includes charges for more
than one hearing: Invoice #4808 reflects charges for the AC 06-39 hearing and the AC 06-40
hearing; and Invoice #4926 reflects charges for the AC 06-41 hearing and the AC 07-25 hearing.
Some of the charges on Invoice #4808 and on Invoice #4926 do not clearly distinguish between
hearings. To avoid imposing any costs that may relate to the AC 06-39 or AC 07-25 hearing, the
Board will take a very conservative approach with these invoices. The Board therefore requires
Mr. Gonzalez and 130th LLC to pay only for the respective hearing costs that plainly relate
solely
to either the AC 06-40 hearing or the AC 06-41 hearing. For example, Invoice #4926 lists
$200.00 for 4.0 hours of reporter attendance, but does not specify how much of that time was
spent on the AC 06-41 hearing as opposed to the AC 07-25 hearing. The invoice also provides
only single charges for the disk of transcription and for delivery of the transcripts. With Invoice
#4926 then, the Board will not assess any of the charges for the reporter’s attendance, the disk, or
the delivery, but instead will assess only the cost per page ($4.75) for the 313-page AC 06-41
transcript.
Proceeding in this manner and applying the rates set forth above, $1,675.50 of the
Board’s actual court reporting costs are associated with the AC 06-40 hearing and $1,486.75 of
the Board’s actual court reporting costs are associated with the AC 06-41 hearing. Because four
but not all five of the alleged violations were established at the AC 06-40 hearing and likewise
for the AC 06-41 hearing, the Board will reduce each hearing cost assessment by one-fifth.

(Dec. 7, 1995) (reducing assessment of Board hearing costs by one-third where hearing resulted
in the establishment of only two of the three alleged violations). Accordingly, under Section
42(b)(4-5) of the Act, Mr. Gonzalez must pay $1,340.40 for the cost of the AC 06-40 hearing
and 130th LLC must pay $1,189.40 for the cost of the AC 06-41 hearing. The Board finds these
hearing costs to be reasonable. If Mr. Gonzalez or 130th LLC objects to the imposition of any of
these charges, either respondent may file a motion to reconsider or modify or a petition for
judicial review.

CONCLUSION
The order below sets forth the Board’s findings with respect to alleged violations in AC
06-39, AC 06-40, AC 06-41, and AC 07-25. The order also includes the imposition of civil
penalties and the assessment of hearing costs in AC 06-40 and AC 06-41. The Board
incorporates by reference the findings of fact and conclusions of law from its March 19, 2009
interim opinion and order. Under Section 31.1(d)(2) of the Act (415 ILCS 5/31.1(d)(2) (2006)),
the Board attaches the administrative citations filed in AC 06-40 and AC 06-41 and makes them
part of the Board’s final order. This final opinion and order constitutes final action by the Board
in all four administrative citation proceedings.
This final opinion constitutes the Board’s findings of fact and conclusions of law.
ORDER
1.
In AC 06-39, the Board finds that CDOE did not prove that SGLI violated Section
21(p)(1), (p)(2), (p)(3), (p)(4), or (p)(7)(i) of the Act on March 22, 2006.
2.
In AC 06-40, the Board finds that on March 22, 2006, Mr. Gonzalez violated
Sections 21(p)(1), (p)(2), (p)(3), and (p)(7)(i) of the Act. The Board finds that
CDOE did not prove that Mr. Gonzalez violated Section 21(p)(4) of the Act on
March 22, 2006.
3.
In AC 06-41, the Board finds that on March 22, 2006, 130th LLC violated
Sections 21(p)(1), (p)(2), (p)(3), and (p)(7)(i) of the Act. The Board finds that
CDOE did not prove that 130th LLC violated Section 21(p)(4) of the Act on
March 22, 2006.
4.
In AC 07-25, the Board finds that the administrative citation against 130th LLC
for alleged violations of Sections 21(p)(1) and (p)(7)(i) of the Act on October 3,
2006, was improperly issued and dismisses the administrative citation.
5.
In AC 06-40, the Board assesses Mr. Gonzalez the statutory civil penalty of
$6,000 for the four violations, as well as hearing costs totaling $1,340.40, for a
total amount due of $7,340.40. In AC 06-41, the Board assesses 130th LLC the
statutory civil penalty of $6,000 for the four violations, as well as hearing costs
totaling $1,189.40, for a total amount due of $7,189.40.

Mr. Gonzalez and 130th LLC must pay these respective total amounts no
later than July 21, 2009, which is the 45th day after the date of this order.
Mr. Gonzalez and 130th LLC must pay by certified check or money order,

made payable to the City of Chicago. The respective case number, case
name, and respondent social security number or federal employer
identification number must be included on the certified check or money
order.

Payment of the penalty does not prevent future prosecution if the
violations continue.

be appealed directly to the Illinois Appellate Court within 35 days after the Board serves the

rear

near the entrance

employee,

information

investigation

Kachter
then
stated
that
he
would

illegal

manifest

people

site

he proceeded
to drive
off onto

other
side

the
property

his employees
