Illinois.
The property
is
commonly known
to
the Illinois Environmental
Protection
Agency as Sailor
Springs/Leigh,
Marty
D.
&
Peggy
J.
2.
That said facility is
an
open dump
operating without
an Illinois
Environmental
Protection Agency Operating
Permit
and is designated Ath
Site Code
No. 0250250001.
3.
That Respondents
have
owned/
operated
said facility
at all times pertinent
hereto.
4.
That on
May 4, 2009, Garrison
Gross
of the Illinois
Environmental
Protection
Agency’s
(“Illinois EPA”) Marion
Regional Office
inspected
the above-described
facility. A
copy of
his
inspection
report
setting
forth the results
of said inspection
is attached hereto
and
made
a part
hereof.

VIOLATIONS
Based
upon direct observations
made by
Garrison Gross
during
the
course
of his
May
4,
2009 inspection of the
above-named
facility, the Illinois
Environmental
Protection Agency
has
determined
that Respondents
have violated
the Illinois Environmental
Protection
Act
(hereinafter,
the “Act”)
as
follows:
(I)
That Respondents
caused
or allowed the
open
dumping
of waste in
a manner
resulting in litter,
a violation of
Section 21
(p)(1)
of the Act, 415 ILCS
5/21
(p)(1)
(2006).
(2)
That
Respondents caused
or allowed the
open dumping
of waste in
a manner
,esulting in
proliferation of disease
vectors,
a
violation of Section
21
(p)(5)
of the
Act, 415
ILCS
5/2fl)(5)(2006).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5) of
the Act, 415
ILCS 5/42(b)(4-5) (2006),
Respondents
are
subject
to a civil penalty
of One Thousand
Five Hundred
Dollars
($1,500.00)
for each
of the
violations
identified
above,
fora total of Three Thousand
Dollars
($3,000.00).
If
Respondents
elect
not to
petition
the
Illinois Pollution
Control Board,
the statutory
civil penalty specified
above
shall
be
due
and
payable
no later than July
30,
2009,
unless otherwise provided
by order
of the
Illinois
Pollution Control
Board.
If
Respondents
elect to contest
this Administiative
Citation
by petitioning

the Illinois Pollution
Control
Board in
accordance with Section 31.1 of the
Act, 415 ILCS
5/31.1
(2006),
and if the Illinois Pollution
Control Board issues a finding of violation
as alleged herein,
after
an adjudicatory hearing,
Respondents shall be assessed the
associated hearing costs
incurred
by
the Illinois
Environmental Protection
Agency and the Illinois Pollution Control Board.
Those hearing
costs shall
be assessed in addition to the One Thousand Five
Hundred Dollar ($1,500.00)
statutory
civil
penalty for each violation.
Pursuant to
Section 31.1 (d)(1) of the Act, 415 ILCS
5/31.1 (d)(1) (2006), if Respondents
fail
to petition
or elect not to petition the Illinois Pollution
Control Board for review of this
Administrative
Citation within thirty-five (35)
days
of the
date of service, the Illinois Pollution
Control
Board
shall
adopt a final order, which shall include
this
Administrative Citation and findings
of violation
as
alleged herein, and shall impose the statutory
civil penalty specified above.
When payment
is made, Respondent’s
check shall be made payable to
the Illinois
Environmental Protection Trust Fund and mailed to
the attention of Fiscal Services,
Illinois
Environmental Protection
Agency, 1021 North Grand Avenue
East, P.O. Box 19276,
Springfield,
Illinois 62794-9276. Along with
payment, Respondents shall complete
and return the
enclosed
Remittance Form to ensure proper
documentation
of payment.
If any civil penalty and/or
hearing costs are not paid within the time prescribed
by order
of the
Illinois Pollution Control Board, interest
on said penalty and/or hearing costs
shall be assessed
against the Respondents from the
date payment is due up to and including the
date that payment
is
received. The
Office of the
Illinois Attorney General may
be
requested to initiate
proceedings
against Respondents in Circuit Court to collect
said penalty and/or hearing costs,
plus any interest
accrued.

Inspection
was
conducted
on
Monday,
May
4,
2009,
at
the
residence
of
Marty
D.
&
Peggy
J.
Leigh.
The
residence
is
located
at
409
East
Second
Street,
Sailor
Springs,
Illinois.
Garrison
Gross
of
the
Illinois
EPA
Bureau
of
Land
conducted
the
inspection.
The
inspection
was
performed
as
a
follow
up
to
a
previous
inspectionconducted
on
October
22,
2008.
Weather
conditions
at
the
time
of
the
inspection
were
mostly
cloudy,
60°
F,
with
a
light
breeze.
The
inspection
began
at
approximately
9:50
AM.
This
Inspector
arrived
at
the
address
and
observed
the
property
from
offsite.
Wastes
overgrown
in
vegetation
includingbut
not
limited
to
vehicles,
lawn
mowers,
furniture
and
tireswere
observed
from
the
public
roadway
(photos
001-008).
This
Inspector
observed
a
parked
vehicle
with
a
female
occupant
near
the
residence.
This
Inspector
identified
himself
and
explained
the
reason
for
the
inspection.The
occupant
of
thevehicle
stated
that
she
was
the
daughter
of
the
Leigh’s
and
that
she
lived
at
the
house.
She
stated
that
no
one
was
home
butthat
she
would
contact
her
mother.
This
Inspector
continued
the
inspection
by
walking
and
photographing
the
site.
Wastes
including
but
not
limited
to
vehicles,
vehicle
parts,
lawn
mowers,
bicycles,
household
furniture,
metal,
tires,
and
domicile
waste
(trash)
were
observed
at
the
site(photos
009-015
and
019).
Most
of
the
waste
items
were
observed
in
the
same
location
as
observed
during
the
previous
inspection.
The
waste
vehicles
were
either
damaged,
missing
components,
or
not
displaying
valid
license
plates.
Three
of
the
waste
vehicles
had
been
moved
to
different
locations
on
the
site.
No
newevidence
of
open
burning
was
observed.
Approximately
20
used
/
waste
tires
were
observed
at
the
site.
Some
of
the
tires
were
off
the
rim
and
wereholding
water
(photo
016-018).
Leaf
litter
and
mosquito
larvae
were
observed
in
the
tires
thatwere
holding
water.
Approximately
130
cubic
yards
of
wasteremains
at
the
site.
Peggy
Leigh
arrived
a
few
minutes
later.
Mrs.
Leigh
was
questioned
about
the
progress
of
the
cleanup.
She
stated
that
she
was
the
only
one
working
on
the
cleanup
because
everyone
else
in
the
household
worked
long
hours.
Mrs.
Leigh
stated
that
her
nephew
workedfor
a
salvage
yard
in
Cisne,Illinois.
She
said
it
was
her
understanding
that
the
business
would
come
to
the
property
and
remove
the
waste
vehicles
and
metal.
Mrs.
Leigh
stated
that
it
had
rained
a
lot
and
the
property
was
too
muddy
for
the
salvage
yard
to
do
any
work.
Mrs.
Leigh
identified
two
vehiclesthat
belonged
to
other
people.
One
belonged
to
her
brother
and
the
derbycar
belonged
to
her
son.
She
stated
that
she
was
working
with
the
insurance
company
concerning
disposal
of
the
silver
car.
ThisInspector
informed
her
that
mosquitolarvae
wereobserved
in
a
number
of
the
tires.
She
mentioned
taking
the
tires
to
a
county
cleanup
or
Calvin
Booth’s
salvage
yard.
She
was
informedthat
the
Agency
was
not
currently
conducting
county
cleanups
and
suggested
that
theyuse
a
registered
tire
hauler
such
as
Booth.
This
Inspector
asked
her
why
she
had
failed
to
send
a
written
response
to
the
Agency
concerning
the
ACWN.
Mrs.
Leigh
said
she
didn’t
know
she
wasrequired
to
respond.
This
Inspector
suggested
that
she
submit
a
written
response.
The
inspection
ended
at
approximately
10:10
AM.
