I
understand
that
Fox Moraine
has made a claim
that the hearings
that took place
in Yorkville
re
garding the application
for
a landfill
were
fundamentally
unfair.
I regret
that
I was unable to
at
tend
your hearings
in April due to
a
recent surgery that
I had.
I attended
all the public landfill
hearings
and
found
them
to be exhausting
with
detail and
protocol,
but
never
did I fmd them to
be
unfair
towards
Fox
Moraine.
Infact
they
consistently had
a team
of
legal council
and
about a half
dozen of
support people present
at all times.
These
individuals,
along
with
Derke Price, and Michael
Blazer
were
being
consistent
watchdogs
and would
make
sure
that
the
hearings
and
discussion did
not leave the legal
parameters.
I would like
to
point out that right
up until the very
end in the
closing
statements
Fox Moraine’s
legal
representation
was
confident
that
they were
going
to
get approval for the
citing
of this
land
fill.
In all newspaper
quotes and releases
their confidence
remained
and made
no mention
of the
hearings being fundamentally
unfair, until the vote
didn’t favor them.
I
think
the
timing of
their
discontent
clearly
points to the truth.
I want to thank you for
extending
the
opportunity
to express my
observations and ask
you
to con
sider them in your
fmal decision.

The
main
issue
of appeal
for
the
case
above
, as
we
understand,
is Fox
Moraine
LLC
does
not
think
they
were
treated
fairly
at
the
siting
hearings.
Myself
&
my
wife
attended
many
of the
weekly
evening
& Saturday
siting
meetings
to
keep
abreast
of what
was
stated
at the meetings
first
hand.
We definitely
feel that
both
sides
of the
issues
were
treated
as fairly
as
possible
to present
their
side
of
all the
issues
that
were
covered
throughout
the
siting hearings
we
attended.
Over
all,
we
feel the
hearing
officeer
in charge
of the
siting
hearings
tried
to
show
fairness
to both
sides
of the
issues
at
hand.
We
obtain
hard
copies
of transcripts
on
the meetings
we
were
able
& not
able to
attend.
We
have
reams
of paper
from
the
siting
hearings
that
we have
read.
I am
sure the
PCB
has
the
same
info
to
digest
as part
of their
process
to make
a ruling
on this
case.
I will not
take
any
more of
you
time
with
items
I personally
feel
Fox-Moraine
LLC
do
not
prove
“without
a doubt
“ per
Illinios
E.P.A.
guidelines
on siting
a dump
during
the siting
hearings.
We
feel
that
the
interest
shown
by
large
crowds
of
community
members
attending
the
siting
hearings
was
not
expected
or well
received
by the
Fox-Moraine
group.
Thus,
during
the
appeal
hearings,
they took
the approach
of
not being
treated
fairly
at
the siting
hearings
& are
trying
to
discredit
the
Yorkville
council
members
to gain
the siting
approval.
