HEARING OFFICER ORDER
On May 18, 2009, the complainants filed a motion to withdraw their interlocutory
appeal of the hearing officer’s denial of motion to bar expert. Complainants’ interlocutory
appeal was filed on February 20, 2009. On May 20, 2009, the respondent informed the
hearing officer that it will not file a response.
Complainants’ motion to withdraw is granted.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on July 1, 2009, at 10:00 a.m. The telephonic
conference must be initiated by the complainant, but each party is nonetheless responsible
for its own appearance. At the conference the parties must be prepared to discuss the
status of the above-captioned matter and whether a hearing need be scheduled.
