HEARING OFFICER ORDER

On May 18, the parties informed the hearing officer that the parties want to

monitor the respondents’ remedial efforts to abate the noise allegations for the next 90

days. To that end, and by agreement, respondent’s answer or other pleading is now due to

be filed on or before September 30, 2009. The June 4, 2009, telephonic status conference

is cancelled and continued to the date and time noted below.

The parties or their legal representatives are directed to participate in a telephonic

status conference on September 17, 2009, at 11:30 a.m. The status conference must be

initiated by the complainant, but each party is nonetheless responsible for its own

appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing. If, however, a motion to

voluntarily dismiss is filed prior to the next status conference, the conference will be

cancelled without further notice.
