HEARING OFFICER ORDER
On May 14, 2009, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that depositions are proceeding and that they
will submit a revised discovery schedule within the next 10 days. In light of the revised
discovery schedule, the complainant represented that its “Second Request to Expedite”,
filed February 25, 2009, is moot.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on July 16, 2009, at 12:00 p.m. The telephonic
conference must be initiated by the complainants, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
