    (“Respondent”)
    is the present
    owner
    and operator
    of
    a
    facility
    located
    at
    Lock and
    Dam
    Road,
    Quincy, Adams
    County,
    Illinois. The
    property
    is
    commonly
    known
    to
    the
    Illinois
    Environmental
    Protection
    Agency as
    Quincy/Blickhan
    Landfill.
    2.
    That said
    facility
    is
    an
    open
    dump
    operating
    without an
    Illinois
    Environmental
    Protection
    Agency
    Operating
    Permit
    and is
    designated
    with Site
    Code
    No. 0010650002.
    3.
    That
    Respondent
    has owned
    and
    operated said
    facility
    at
    all times
    pertinent
    hereto.
    4.
    That on
    March 17,
    2009,
    Paul
    Eisenbrandt
    of
    the Illinois
    Environmental
    Protection
    Agency’s
    Springfield
    Regional
    Office inspected
    the
    above-described
    facility.
    A copy
    of
    his
    inspection
    report
    setting
    forth the
    results
    of said inspection
    is attached
    hereto
    and
    made
    a part
    hereof.

    Based
    upon direct
    observations
    made
    by
    Paul Eisenbrandt during
    the course
    of
    his March
    17, 2009
    inspection
    of
    the above-named
    facility, the Illinois
    Environmental
    Protection
    Agency
    has
    determined
    that Respondent
    has violated the
    Illinois
    Environmental
    Protection
    Act (hereinafter,
    the
    “Act”) as follows:
    (I)
    That Respondent
    caused
    or allowed the
    open dumping
    of waste
    in
    a
    manner
    resulting
    in litter,
    a
    violation
    of
    Section 21(p)(1)
    of the Act, 415 ILCS
    512
    1(p)(l)
    (2006).
    CIVIL PENALTY
    Pursuant
    to Section 42(b)(4-5)
    of the Act,
    415
    ILCS
    5/42(b)(4-5) (2006),
    Respondent
    is
    subject to a civil penalty
    of One Thousand
    Five Hundred
    Dollars
    ($1,500.00)
    for
    each
    of the
    violations identified
    above, for
    a total of One
    Thousand Five
    Hundred Dollars
    ($1,500.00).
    If
    Respondent
    elects
    not to petition the
    Illinois
    Pollution
    Control
    Board,
    the statutory
    civil
    penalty
    specified
    above shall be due
    and payable
    no later than
    June
    15,2009,
    unless
    otherwise
    provided
    by
    order of the Illinois
    Pollution Control
    Board.
    If
    Respondent
    elects
    to contest
    this Administrative
    Citation
    by
    petitioning
    the
    Illinois
    Pollution
    Control Board in accordance
    with Section
    31.1 of the Act,
    415 ILCS 5/31.1(2006),
    and
    if the
    Illinois
    Pollution Control
    Board
    issues a finding of violation
    as alleged
    herein, after
    an adjudicatory
    hearing,
    Respondent
    shall
    be assessed
    the associated
    hearing
    costs
    incurred
    by
    the
    Illinois
    Environmental
    Protection
    Agency
    and the Illinois
    Pollution
    Control
    Board.
    Those hearing costs
    shall be
    assessed

    in addition to
    the
    One
    Thousand
    Five
    Hundred Dollar
    ($1,500.00) statutory
    civil penalty
    for
    each
    violation.
    Pursuant
    to Section
    31.1 (d)(1)
    of the Act,

    Respondent fails

    elects
    not
    to petition the
    Illinois Pollution
    Control
    Board for
    review
    of this
    Administrative
    Citation
    within
    thirty-five
    (35) days of the date

    Board
    shall
    adopt
    a
    final
    order, which shall
    include this
    Administrative
    Citation
    and findings of violation
    as
    alleged herein, and
    shall impose
    the
    statutory
    civil penalty specified
    above.
    When
    payment
    is made, Respondent’s
    check shall be
    made
    payable
    to the
    Illinois
    Environmental
    Protection
    Trust
    Fund
    and mailed
    to the attention of
    Fiscal
    Services,
    Illinois
    Environmental
    Protection Agency,
    1021 North Grand
    Avenue
    East, P.O. Box
    19276,
    Springfield,
    Illinois 62794-9276.
    Along with
    payment,
    Respondent
    shall complete
    and
    return
    the
    enclosed
    Remittance Form
    to
    ensure proper
    documentation
    of
    payment.
    If any civil
    penalty and/or hearing
    costs
    are not
    paid within the
    time prescribed
    by order
    of the
    Illinois Pollution
    Control Board,
    interest on
    said penalty and/or
    hearing
    costs

    The purpose
    of this memorandum
    is to serve
    as
    the Narrative Inspection
    Report Document
    of
    a
    March 17,
    2009
    annual
    landfill
    inspection
    (of the
    above
    referenced site)
    and inspection of
    adjacent
    properties
    (commonly
    known
    as Buck’s Village)
    owned or
    managed by Mr. C. John
    Blickhan.
    While
    performing
    the annual landfill inspection,
    two
    rodent holes (probably
    ground hog)
    were
    observed
    in
    the landfill
    cap
    of Site No.
    2 and three holes were
    observed
    in the
    cap
    of Site
    No.
    1.
    A downed tree
    was observed in
    the southwest corner
    of Site
    No.
    2, which would encumber
    mowing the landfill’s
    vegetative cover
    if
    not removed.
    Ash and charred
    debris was
    observed
    in a
    pile behind
    House 1.
    Garbage
    was
    observed in a pickup
    truck
    and near
    the front door of
    House
    2. Open
    dumped waste
    was observed on
    all sides of House
    6. A landscape waste
    pile mixed
    with household
    garbage
    was observed behind
    Houses
    5
    and 6. Several open
    dumping violations
    were observed in
    Blick’s Village.
    This annual inspection
    took
    place
    from approximately
    10:20 am
    to 12:10 pm, and thirty-two
    digital
    photographs
    were taken.
    The weather at
    the
    time
    of the inspection
    was sunny and
    about
    74°F
    with aS
    mph
    wind from the
    south. Mr. C. John
    Blickhan (owner)
    and Ms. Lori Graupman
    (office
    staff) were interviewed
    during
    the inspection.
    Photographs
    001 shows
    a
    ground hog
    (wood chuck) on top of
    Site No. 2 near the
    east side
    of the
    fill area. Photograph

    shows a ground hog hole
    in
    the cap
    of Site No. 2 (also along
    the east
    side). Pieces
    of broke brick, broken
    glass, mortar,
    and scraps of shingles
    debris
    were observed
    pushed
    out
    of the burrow.

    was observed on
    this side
    of the landfill. The vegetative
    cover
    appeared well maintained.

    trees and

    demolition
    debris have been removed. A large pile
    of landscape waste
    can
    also
    be
    seen in the photograph. No debris
    was
    observed
    on the fill area.

    of Buck’s Village and the previous
    thicket of
    immature
    trees
    that once
    stood
    to
    the
    west
    of the houses, have been removed.
    Photograph 006 shows the west side of Site No.2 landfill. The
    vegetative
    cover
    appears
    well
    maintained and
    no
    debris was
    observed.

    A few pieces of litter
    were
    observed
    on the
    ground
    in front of the gate. The gate was properly locked.

    The inspector walked a

    pattern across the top of
    the landfill.

    on the side slope of the
    landfill. Rusty
    metal,
    aluminum
    scrap, black plastic,
    and
    a
    piece
    of plastic beverage cup
    were observed near
    the hole.

    concrete surface seal was
    covered with
    weeds
    and
    leaves.
    Photograph 013 shows a debris pile of ash and charred waste
    east of House

    Blick’s
    Village.
    The
    tenant for the
    last 20 years came
    out
    of the house and spoke
    with the inspector.
    She
    stated
    she has not
    burned anything since Mr. Blickhan notified her
    of the Agency’s
    previous
    inspection
    last
    year. The ash
    and charred waste
    (rusty aerosol cans, processed
    lumber, nails,
    and scrap
    metal) are
    considered open dumped waste until properly disposed
    at an Illinois
    EPA
    permitted
    solid waste
    facility.

    of House 6 in Blick’s
    Village.
    A
    mop, a grey
    plastic tote, a used tire, cardboard
    boxes, black plastic
    bags of household
    garbage,
    plastic sheeting,
    clothes, and a small diameter tire were
    observed in the front
    yard near the
    road.
    Another used
    tire,
    more
    bags of garbage, and debris was also
    observed on and in
    front of the
    porch.

    plastic bowl, food
    wrappers, beverage cans
    and
    bottles,
    a
    tiki
    torch,
    and
    carpet were

    shop
    vacuum, a
    small used tire, plastic
    bags, a wooden frame to a
    chair, a black plastic

    garbage,
    plastic
    beverage
    bottles, clothes, drapery,
    and
    miscellaneous
    items were among
    the observed

    torn mattress, a
    pillow,
    foam
    padding, a garden hose, clothing, cardboard boxes, scrap lumber,
    scrap
    metal, and
    miscellaneous
    wastes were observed.

    was off the
    southwest corner of House 6.
    Several
    bags of household garbage,
    an electric space heater, video tapes, a fluorescent
    lantern,
    a
    vehicle
    stereo, and
    miscellaneous waste
    were observed.

    a wooden shelf,
    plastic bottles, processed lumber, a
    plastic container,
    and plastic inflatable toys open
    dumped
    on
    a
    concrete pad west of House 6.

    shows all of the immature trees have been removed from behind Houses 5 and 6.
    It appears that
    all of the construction and
    demolition debris
    has been cleaned up from this sward.
    A large pile of landscape waste
    was still observed in the area.

    that within the pile of landscape waste seen in Photograph 020
    are plastic
    bags, plastic bottles, aluminum
    cans, and miscellaneous household waste. The waste
    must
    be
    removed
    and properly disposed prior
    to burning the landscape waste.

    shows thirty-one 5-gallon
    plastic containers that were observed
    southwest of
    House 4.
    The
    visible
    portions of the partial
    labels indicated the plastic jugs were
    originally
    storing
    car wash detergent or car wax
    liquid. The jugs appeared to be mostly filled
    with water
    or
    water and soap mixtures.
    Photograph 023 shows the front yard
    of House 2. Previously a community
    dumpster was staged
    here.
    No dumpster
    was observed within Blick’s Village. The photograph also shows garbage
    stored in the back of a two tone blue
    pickup truck
    and near the front
    door of
    the
    house.

    The precipitation
    runoff
    from
    the landfill
    no
    longer
    drains to
    the south.
    The
    vegetative
    cover
    is
    dirty
    and
    stressed
    as if
    subjected
    to standing
    water.
    Drainage
    will need to
    be corrected
    as
    standing
    water
    may
    impact
    the
    groundwater
    monitoring
    wells.
    No other
    debris
    was
    observed
    on Site
    No.1.
    It
    should
    be
    noted
    that
    the
    Illinois EPA
    inspector
    investigated
    debris
    at
    Buck’s Village
    Court
    several
    times over
    the past
    four years.
    Repeatedly
    Mr.
    Blickhan
    has been
    informed
    about
    the
    alleged
    open dumping
    and open
    burning violations
    observed
    on
    his
    property.
    On
    April 13,
    2009,
    Mr. Blickhan
    called
    the inspector
    at 2:05
    pm.
    The
    inspector
    discussed
    with
    Mr.
    Blickhan
    the
    site
    observations.
    First
    the
    inspector
    identified
    five rodent
    holes
    in
    the
    landfill
    cap. Mr.
    Blickhan
    said
    that it “the
    landfill”
    was a perfect
    environment
    for them
    “the
    ground
    hogs”,
    he
    would
    probably
    have
    to
    shoot them,
    and
    that he would
    fill in the
    holes
    again.
    We
    discussed
    the
    trash
    around
    House 6.
    Mr.
    Blickhan again
    stated
    the
    previous
    tenant
    (now
    removed)
    trashed
    the
    house and
    that it is
    no longer worth
    fixing.
    We
    discussed
    the
    pile of
    landscape
    waste
    behind
    Houses
    5 and 6 and
    the fact
    that it contained
    plastic
    bottle
    and
    household
    trash. Mr.
    Blickhan
    asked
    if he could
    burn
    it.
    The inspector
    said
    yes he could
    burn
    the
    landscape
    waste as
    long
    as he
    removed
    the trash
    from the
    pile first.
    The inspector
    asked
    Mr. Blickhan
    what
    happened
    to
    the
    dumpster
    that used
    to sit in front
    of House
    2. He
    said he
    didn’t
    know
    but that
    the tenants
    probably
    did not
    pay the
    bill and it
    might
    have
    been removed
    by
    the
    garbage
    company.
    The apparent
    violations
    observed
    at Blickhan
    Landfill
    are indicated
    on
    the attached
    Part
    807
    Landfill
    Inspection
    Checklist.
    Section
    22.17(a) and
    (b) were
    cited
    for
    failure
    to monitor
    the
    landfill
    during
    post-closure
    care
    as five rodent
    holes
    were
    observed
    in
    the
    landfill’s
    cap
    and
    remedial
    action was
    not
    taken
    to
    correct
    the
    problem.
    The
    apparent
    violations
    (regarding
    open
    dumping)
    observed
    at Buck’s Village
    are
    indicated
    on
    the
    attached
    Open
    Dump
    Inspection
    Checklist.
