    ORDER OF THE BOARD (by A.S. Moore):
    On April 20, 2009, Apollo Plastics Corporation (Apollo) filed a motion to voluntarily
    dismiss its appeal of the Illinois Environmental Protection Agency’s (Agency) alleged failure to
    make a timely determination on Apollo’s application for an initial federally-enforceable state
    operating permit (FESOP) under the Clean Air Act Permit Program (CAAPP). The appeal
    concerns Apollo’s facility located at 5333 N. Elston Avenue, Chicago, Cook County. Apollo
    states in the motion that the Agency has issued a permit. Motion at 1. The Board grants the
    motion, dismisses the appeal, and closes the docket.
    IT IS SO ORDERED.
