HEARING OFFICER ORDER
On April 30, 2009, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that they are optimistic that a settlement has
been achieved and that petitioner anticipates filing a motion to voluntarily dismiss prior
to the next telephonic status conference. The petitioner also represented that it will file an
additional 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference on July 16, 2009, at 9:00 a.m. The status conference must be initiated
by the petitioner, but each party is nonetheless responsible for its own appearance. At the
status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the status conference, the conference will be cancelled without
further notice.
