HEARING OFFICER ORDER
On April 10, 2009, the respondent filed a “Motion to Modify Discovery Cutoff”.
The initial discovery cutoff date is scheduled for April 17, 2009. Respondent represents
that three individuals who were issued deposition notices by the complainant were not
available because they were on vacation. Motion at 1. The depositions have now been
scheduled for April 20 and 28, 2009. Finally, respondent requests that the discovery
cutoff be extended to April 30, 2009. The respondent states that the complainant will not
be filing a response to this motion.
The respondent’s motion is granted and the discovery cutoff date is now April 30,
2009. All other previously scheduled pre-hearing filing dates remain the same, including
the parties’ respective exhibit and witness lists are due to be filed on or before May 5,
2009; all pre-hearing motions to be filed on or before May 12, 2009; and any responses
are due to be filed on or before May 19, 2009.
A hearing in this matter is scheduled for June 23 and 24, 2009. The time and
location will be noted in the notice of hearing.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on April 30, 2009, at 11:30 a.m. The telephonic
status conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the status conference, the parties must be prepared
to discuss the status of the above-captioned matter and their readiness for hearing.
