RECOMMENDATION
The Illinois Environmental Protection Agency ("Illinois EPA") hereby files its
Recommendation pursuant to Section 125.204
of the regulations of the Illinois Pollution
Control Board,
35 Ill. Adm. Code 125.204.
1.
On December 28,2007, the Illinois EPA received a request from LaMoine Valley
2.
Farms, LLC (log number TC-41-07, Exhibit A) for an Illinois EPA
recommendation regarding the tax certification of water pollution control
facilities pursuant to 35
Ill.
Adm. Code 125.204.
The applicant's address is:
LaMoine Valley Farms, LLC
3051 East County Road 1650
Colchester, Illinois 62326
3.
The proposed water pollution control facilities in this request are located at
Section 13, T5N, R5W of 4th P.M. in Hancock County, at the above street
address and consist
of the following:
Livestock waste management facilities consisting
of one concrete pit (48
ft. x 48
ft. x 2 ft. deep) and the portion ofthe plastic and cast iron slotted
flooring over the manure pit in Building
# 1; one concrete pit (61 ft. x 260
ft. x 8 ft. deep) with six concrete pump out pits (each 4 ft. x 4 ft. x 8 ft.
deep) and the portion of the concrete slotted flooring over the manure pits
in Building
# 2; one concrete pit (77 ft. x 660 ft. x 10ft. deep) with ten
concrete pump out pits (each 4
ft. x 4 ft. x 10 ft. deep) and the portion of
the concrete slotted flooring over the manure pits in Building # 3; one
concrete pit (160 ft. x
440 ft. x 2 ft. deep) and the portion of the plastic and

ft. x 4 ft. x 10ft. deep) and the portion of the concrete slotted flooring over
the manure pits in Building #
5; and approximately 50 ft. of 8 inch
diameter
PVC manure transfer piping.
These livestock waste management facilities are used to collect, transport and/or
store livestock wastes prior
to cropland application, and are further described in
Exhibit
A.
4.
Section 11-10 ofthe Property Tax Code, 35 ILCS 200/11-10 (2006), defines
"pollution control facilities" as:
"any system, method, construction, device or appliance appurtenant
thereto or any portion
of any building or equipment, that is designed,
constructed, installed or operated for the primary purpose of: (a)
eliminating, preventing, or reducing air
or water pollution ... or (b)
treating, pretreating, modifYing or disposing of any potential solid, liquid
or gaseous pollutant which
if released without treatment, pretreatment
modification or disposal might be harmful, detrimental or offensive to
human, plant or animal life, or
to property."
5.
Pollution control facilities are entitled to preferential tax treatment, 35 ILCS
200/11-5.
6.
Based on the infonnation in the application and the purpose ofthe facilities, it is
the lllinois
EPA's engineering judgment that the described facilities may be
considered "pollution control facilities," pursuant to 35 Ill. Adm. Code
125.200(a), with the primary purpose of eliminating, preventing, or reducing
water pollution, or as otherwise provided in 35 Ill. Adm. Code 125.200, and are
eligible for tax certification from the Board.

Agency
The Bureau of Water received a request on December 28,2007 from LaMoine Valley Farms, LLC for an Illinois
EPA recommendation regarding the tax certification of water pollution control facilities pursuant to 35 II. Adm.
Code 125.204. We offer the following recommendation.
The water pollution control facilities in this request include the following:
LaMoine Valley Farms,
LLC
3051
East County Road 1650
Colchester,IL 62326
Section 13, T5N, R5W of 4th P.M. in Hancock County
Livestock waste management facilities consisting of one concrete pit (48 ft. x 48 ft. x 2 ft. deep) and the
portion
of the plastic and cast iron slotted flooring over the manure pit in Building # I; one concrete pit (61
ft. x 260 ft. x 8 ft. deep) with six concrete pump out pit' (each 4 ft. x 4 ft. x 8 ft. deep) and the portion of
the concrete slotted flooring over the manure pits in Building # 2; one concrete pit (77 ft. x 660 ft. x lOft.
deep) with ten concrete pump out pits (each 4 ft. x 4 ft. x lOft. deep) and the portion of the concrete slotted
flooring over the manure pits in Building
# 3; one concrete pit (160 ft. x 440 ft. x 2 ft. deep) and the portion
of the plastic and cast iron slotted flooring over the manure pit
in
Building # 4; one concrete pit (77 ft. x
660 ft. x 10 ft. deep) with ten concrete pump out pits (each 4 ft. x 4 ft. x 10 ft. deep) and the portion of the
concrete slotted flooring over the manure pits
in
Building # 5; and approximately 50 ft. of 8 inch diameter
PVC manure transfer piping. These livestock waste management facilities are used to collect, transport,
and/or store livestock wastes
prior to cropland application.
These facilities are further described
in
the enclosed applications and supporting documents.
Based on the information included in this submittal, it is our engineering judgment that the above proposed facilities
may be considered "Pollution Control Facilities" under 35 lAC I 25.200(a), with the primary purpose of eliminating,
preventing,
or reducing water pollution, or as otherwise provided in this section, and therefore eligible for tax
certification from the Illinois Pollution Control Board. The Bureau of Water therefore recommends that the Board
issue the requested tax certification for these facilities.
If you have any questions regarding the above, please contact James Allison at
2171782.3362.

Attached Sheet in Support of Application for Certification of Pollution Control Facility
For LaMoine VaHey LLC
Page 1 Section D of the form -
LaMoine VaHey LLC is a swine farm with 5 separate buildings.
Each of these building has manure storage capacity in below ground level concrete pits.
Also integrated into the design is specially designed flooring material that separates the
animals from the manure holding area, yet allows the manure to pass
thru
the floor into
the holding area. The flooring in buildings I
&
4 have a combination of slatted plastic
&
cast iron flooring that allows for manure to pass thru into the below ground storage pits.
Buildings 2, 3,
&
5 have slatted floor made of concrete, re-enforced with steel.
Buildings 1
&
4 (from diagram below) have manure pits that drain into,
thru
underground
piping, buildings 2,3
&
5. This underground piping consists of8" PVC pipe; these lines
are approximately 50 feet long, the distance between buildings. Buildings 2, 3,
&
5 have
deep concrete (8'
&
10') pits below them that will retain approx 12 months worth of
manure produced by the animals at the farm. Manure is retained by these structures to
prevent it from leaving the farm and reaching surrounding water sources. The nearest
body of water is approx 114 of a mile from the building site. MUltiple times each year the
manure is pumped out of the pits and injected into surrounding farmland at
ergonomically appropriate rates. Each of the buildings with deep pits have multiple
pump out locations located on the longer sides of the buildings. These pump out
locations are approx 4 feet square and are made of concrete
&
steel. They are poured as
floors and walls ofthe building are constructed. This feature allows for portable pumps
to be lowered into the pits from the outside of building.
Collection efficiency of this design of pollution control facility is 100%.
On the accompanying diagram the buildings are identified as 1-5 with approx.
dimensions listed at the top of each. Arrows between buildings indicate the direction and
flow of manure from one building to another.
