HEARING OFFICER ORDER
On March 23, 2009, all parties participated in a telephonic status conference with
the hearing officer. Petitioners made an oral motion for leave to file an amended petition.
Respondent had no objection. Petitioners’ motion is granted. Petitioners anticipate that
the amended petition will be filed within the next 2 days.
Petitioners represented that the amended petition will not include any new
grounds for appeal, only additional facts and circumstances surrounding the grounds for
appeal. The parties are hopeful that the amended petition will obviate the need for
petitioners to file a motion to compel or a ruling on the previously filed respondent’s
Demand for a Bill of Particulars, and assist in the discovery process.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on April 2, 2009, at 2:00 p.m. The telephonic
conference must be initiated by the petitioners, but each party is nonetheless responsible
for its own appearance. At the conference the parties must be prepared to discuss the
status of the above-captioned matter and their readiness for hearing.
