HEARING OFFICER ORDER
On March 12, 2009, all parties participated in a telephonic status conference. Discussions
centered on Complainants “Second Request to Expedite” that was filed on February 25, 2009.
Complainants request is essentially a pleading to compel respondents to adhere to the agreed
discovery schedule. It was agreed by all parties that a revised discovery schedule will be
submitted in an effort to resolve the complainants’ concerns and proceed with discovery in an
orderly manner.
On March 13, 2009, the respondents submitted an amended proposed discovery schedule.
The discovery schedule is accepted to the extent as follows. Respondents to tender the 2005
Noise Report and Color Version of Noise Test on or before March 26, 2009. Oral depositions of
fact witnesses (non-expert) to be completed on or before April 24, 2009. Disclosure of expert
opinions by both parties on or before April 30, 2009. Expert witness depositions to be completed
on or before May 31, 2009.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on April 16, 2009, at 12:00 p.m. The telephonic conference
must be initiated by the complainants, but each party is nonetheless responsible for its own
appearance. At the conference the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing.
