HEARING OFFICER ORDER
On March 16, 2009, the parties participated in a telephone status conference with
the hearing officer. Complainant reports that respondent has not complied with the
discovery deadlines thus far, and complainant objects to any formal extensions of time
for respondent to provide discovery responses. Respondent agreed to speak to
complainant after the status conference to provide discovery responses. In light of the
discovery delays, the deadline for depositions is extended to April 20, 2009.
Respondent was further advised that the request for documents filed with the
Board on February 17, 2009 needs to be sent to complainant. The parties continue to
discuss the possibility of settlement.
The parties are directed to participate in a telephone status conference with the
hearing officer at 2:00 p.m. on May 18, 2009. The status conference shall be initiated by
the complainant.
