HEARING OFFICER ORDER
On March 9, 2009, the parties participated in a telephone status conference with the
hearing officer. The deadline for the Illinois Environmental Protection Agency to file the
administrative record is March 20, 2009. The mailbox rule will apply. Upon review of the
administrative record, the parties will decide whether to file motions for summary judgment, or
proceed directly to hearing.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on April 8, 2009. The status conference shall be initiated by the petitioners.
The decision deadline is currently June 18, 2009. Respondent Sugar Camp Energy
agreed to file a waiver to December 31, 2009.
