ORDER OF THE BOARD (by G.T. Girard):
On February 20, 2009, the Board received a joint notice to extend the 35-day period for
J.I. Corporation (petititioner) to appeal a January 30, 2009, determination of the Illinois
Environmental Protection Agency (Agency).

415 ILCS 5/40(a)(1) (2006); 35 Ill. Adm. Code
101.300(b), 105.208(a). According to the joint notice, petitioner received the Agency
determination on February 2, 2009. The determination concerns petitioner’s leaking
underground storage tank site, located in Boone County and known to the Agency at LPC#
00790057109. In the determination, the Agency denied petitioner J.I. Corporation’s request for
reimbursement for costs associated with removal of the UST and remediation of the site.
The Board extends the appeal period until June 17, 2009. ILCS 415 5/40(a)(1) (2006);

35 Ill. Adm. Code 105.406. If petitioner J.I. Corporation fails to file an appeal on or before
that date, the Board will dismiss this case and close the docket. 35 Ill. Adm. Code 105.404
(2006).
