HEARING OFFICER ORDER
On March 5, 2009, all parties participated in a telephonic status conference with
the hearing officer. The complainant represented that the anticipated supplemental
environmental project was rejected and that this enforcement matter should proceed in
litigation. By agreement, respondent’s answer or other pleading is now due on or before
March 27, 2009.
It was further agreed that the respondent will forward a document to the
complainant on or before March 9, 2009, addressing a possible severance or settlement of
a few allegations in the complaint. The parties anticipate discussions prior to the next
telephonic status conference regarding the document.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on March 23, 2009, at 11:30 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
