Illinois.
The

Illinois

The property
is
commonly
known
to the Illinois
Environmental Protection
Agency
and the
County
of Sangamon
as AubumlLanders’
Children
Family,
LLC.
2.
That
said facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection
Agency
Operating
Permit
and
is
designated
with
Site
Code
No.
1678005010.
3.
That
Respondent
has
owned
and/or
operated
said
facility
at
all times
pertinent
hereto.

determined
that
Respondent
has
violated
the
Illinois
Environmental
Protection
Act
(hereinafter,
the
“Act”)
as
follows:

Respondent
caused
or allowed the
open
dumping
of
waste
in a
manner
resulting
in
litter,
a violation
of Section
21(p)(l)
of
the
Act,
415
ILCS
5/2l(p)(l)
(2006);
(2)
That
Respondent
caused
or
allowed
the
open
burning
of
waste,
a
violation
of
Section
2l(p)(3)
of
the Act,
415
ILCS
5121(p)(3)
(2006);
and
(3)
That
Respondent
caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in deposition
of
general
construction
or
demolition
debris
or
clean
construction
or
demolition debris,
a
violation
of
Section
21
(p)(
7
)
of
the
Act,
415
ILCS
5/21(p)(7)
(2006).
CIVIL
PENALTY
Pursuant
to
Section
42(b)(4-5)
of
the
Act,
415
ILCS
5/42(b)(4-5)
(2006),
Respondent
is
subject
to
a
civil
penalty
of

Thousand

Hundred
Dollars
($1,500.00)
for
each
of the

field inspector
employed by the Division of Land Pollution
Control/Field
Operations
Section of the Illinois
Environmental
Protection Agency and has been so
employed
at
all times pertinent hereto.
2. On January 8,
2009
between 1:37 PM and 2:44 PM, Affiant conducted
an inspection
of a disposal site operated without an Illinois Environmental Protection Agency
permit,
located in Sangamon County, Illinois, and known as Auburn/Landers’
Children
Family,
LLC by the Illinois Environmental Protection Agency. Said site
has been assigned site
code
number LPC# 1678005010
by
the Illinois Environmental Protection Agency.
3.
Affiant inspected said Auburn/Landers’ Children Family, LLC open dump site
by
an
on-site inspection, which included walking and photographing the site.
4. As a result of the activities referred to in paragraph 3 above,
Affiant completed the
Inspection Report form attached hereto and made
a
part hereof,
which,
to
the
best
of
Affiant’s knowledge and belief, is an accurate representation of
Affiant’s observations and
factual conclusions with respect to said
AuburnlLanders’ Children Family, LLC open
dump.

The purpose
of this memorandum
is
to
serve
as
the Narrative Inspection
Report Document
of a
January
8,
2009
complaint investigation
of the above referenced
site. An
anonymous
complaint
alleged
open dumped trash, demolition
debris,
and
miscellaneous
waste were
being
disposed of
at the site. This is the
second
site
inspection and it took
place
from about
1:37 pm
to
2:44
pm,
and twenty-five
(25) digital
photographs were
taken. The weather was
sunny and
approximately
32°F.
No one was interviewed
during
the inspection.
When the
inspector
drove
into the drive he
noticed the
modular
home, the metal
canopy garage-
like
structure,
and the long thin shed,
have
been
removed from the
property. After
exiting the
vehicle
and taking a
closer look more
waste was observed than
initially documented
in
July
2008.
With
the vegetation down
for
the winter,
addition
waste
was
apparent.
The inspector had
estimated the amount
of
waste
initially
at
20
cubic yards.
However,
as a
result of this second
inspection,
it
was
determined
that approximately
70-80 cubic
yards of wastes were
observed.

001 is a street
elevation view
showing
the mobile home
has been
removed from the
property.
The wooden
stair platform
and deck from the
north side of
the home were still onsite.

is a view showing the
footprint of
the modular home
site. Electric feeder
lines,
metal tie
down straps,
black plastic pipe, concrete
and cinder
blocks,
aluminum
skirting,
cardboard, and
miscellaneous
debris
was observed
around the home
footprint.
This
waste was
not
observed
during
the first inspection
as an inhabitable
home was still
onsite. In the
photograph
a
second set of
wooden stairs can
been seen.
Photograph
003 shows
the
area
from where the
metal
canopy
was removed.
It appears most of
the
items originally
seen in the garage-like
structure have
been moved.
However,
cinder
block,
concrete
block, cut
up
pieces
of wood furniture,
weathered
landscaping
timbers,
an
old bleached
basketball,
a rag rug, a
blanket, grey
closed-cell Styrofoam
and
dimensional
lumber
(attached to
form a
primitive
slide-like object),
and other miscellaneous
debris were
observed.
In
the tall
vegetation
in the
background of the
photograph,
a
black
truck topper
can be
seen.
Photograph
004 shows a yellow
metal gallon gasoline
can that
was
observed
on its
side.
The can
contained at
least
1/4
gallon of strong
gasoline like smelling
liquid.
The
inspector
adjusted the
n2aI
1
can so no
additional
fluid would be
released
to the
environment. A metal
strap
tie
down,
the
electric feeder lines,
and miscellaneous
waste
can also be seen
in the photograph.

shows five used
truck tires observed
in the trees north on
the modular
home
footprint. All of
the waste tires were
off-rim and three were
partially buried upright.

rotting dimensional
lumber, a weather brown
pet
carrier, landscape
timbers,
scraps
of
carpet, pieces
of wood paneling,
and miscellaneous debris
that
were
observed
in the
trees in the northeast
corner
of the
property. The tires
described in Photograph
005 can
also be seen
in Photograph 006.
Photograph 007
shows an alternate view
of the black
truck topper described
in
Photograph
003.
Cinder block,
small scraps of processed
lumber,
railroad ties, and miscellaneous
waste
were
scattered
throughout this graveled
area. A
grey garbage can with
a skin to a
trampoline
were
also
observed nearby.
During the previous
inspection
on July 1, 2008 a
large
debris
pile
of
weathered waste
was
observed
roughly
near
this
location. A dresser,
paneling, beige
vinyl
siding,
particle board
shelving, cinder block,
a yellow
bathtub, a rusty
wheel rim with
tire
beads,
waste pipe,
carpet, children
toys, and charred
lumber were among
the
weathered
wastes
that
have
been removed
from the property.

and brown shed
that was
observed
with
its
doors open.
The burn
barrel, a stack of weathered
lumber,
a
broken
small animal
coop, and
miscellaneous
debris
previously observed
were still on
the ground near the
empty shed.

glass,
and charred lumber
are still in
the makeshift
burn
barrel. No waste
from around this area
has
been cleaned
up.

with a tree growing
through it illustrating
the
waste
tire
had
been
dumped
many
years earlier.

covering
a loose stack
of
railroad
ties.
A
rusty dog
house made from scrap
metal was observed
upside down.
Fragmented white
plastic
debris
was
also
observed in
the weeds.

fiberglass panels, rotting
pallets,

plastic drain
pipe, steel sheeting,
rotting dimensional
lumber, fiberglass
insulation,
a black plastic
utility tub,
and
rotting debris
were still observed
in the northern tree
line.

(two on-rim) that
were
observed
in the northern
tree line,
just
east
of an
opening
in the
weeds. These used tires
were observed
during
the
July 2008
inspection.

primitive building constructed of corrugated sheet
metal, wooden
pallets, and scrap lumber, which appears more dilapidated than when
it
was observed
during the
July 2008 inspection. The building is still surrounded by weeds
approximately four
to
five feet
high.
Photograph 020 shows
a
large debris pile containing
wire fencing,
scraps of corrugated
sheet
metal, rusty scrap metal, rotting processed
lumber, plastic plumbing pipe, charred wood,
and
debris was
newly observed. This debris pile was covered with
thick vegetation during the
previous inspection. The debris pile is
approximately four feet high and fifteen feet
across.
Photograph 021 shows the old wooden shed with
debris spilling
out
of it appears as
it did
during
the last inspection. A recliner, a
wooden frame,
a
torn mattress, a box spring,
and six
used
tires
were again observed.
Photograph 022 shows additional waste was discovered southeast
of the old wooden shed. The
large debris pile in the background is also seen in
Photograph 020.
Photograph 023 shows more waste was discovered
against the southern side of the
old green
shed.
Corrugated sheet metal, scrap steel, rotten lumber, PVC pipe,
cyclone fencing, concrete
block, aluminum scrap, gravel and dirt laden with
small debris, and slate-like tile was observed.
The debris pile was
approximately five feet high and greater than ten feet
across.

material were collected
for laboratory
examination.
Along
the western
fence line,
a
stack of rusty metal was observed,
possibly pieces to a
livestock
corral.
An
Administrative Citation Warning
Notice
was
issued to Jennifer
Chance on August 7,
2008,
the
registered agent for the land
owner, Landers’ Children Family,
LLC, which is
responsible for
the
wastes
open dumped on their property.
Any
debris and
unusable
wastes
located outside of the
sheds must be
cleaned
up.
Scrap
metal
not
disposed at a
landfill can
be
taken to a
scrap metal facility or
recycling
center.
All
the
remaining useable
materials should be organized
in
a
manner that
depicts a
useable
storage
area
rather than an open
dump.
On January 9,
2009 the inspector met
with the Illinois EPA BOA asbestos investigator. After
examining
the
aforementioned samples they were bagged
again and sent of to a contract
laboratory
to
determine if the
samples contained asbestos containing material (ACM). On
January 15, 009 the
Springfield Field Office received the laboratory
results
from Mr.
Alan
Grimmett, BOA
asbestos inspector. The TEM Incorporated
laboratory results indicate
two (2) of
the four
(4) samples were ACM positive for 5 to 10% chrysotile fibers. A copy of the results are
attached to this
narrative.
The apparent violations
observed
as a
result of this inspection are indicated on the attached
Open
Dump
Inspection Checklist. A site sketch, digital photographs, and an
