MOTION TO MODIFY AND EXTEND BRIEFING SCHEDULE
Now comes Complainant, PEOPLE OF THE STATE OF ILLINOIS, by LISA
MADIGAN, Attorney General
of the State of Illinois, and requests that the Hearing Officer
modify the schedule for filing post-hearing briefs. In support thereof, Complainant states as
follows:
1) On January 28, 2009, the Hearing Officer established a briefing schedule whereby
Complainant would file its initial
Post-Hearing Brief on February 16,2009, Respondent to file its
Response by March
31,2009, and Complainant to file its Reply by April 14,2009.
2) February 16, 2009 is a holiday, and Board offices will be closed. In addition,
Complainant seeks additional time
to allow to consult with Illinois EPA prior to filing its initial
brief. Complainant therefore request that the filing date for its initial
Post-Hearing Brief be
extended to Friday, February
20,2009.
3) Counsel for Respondent Toyal America Inc. has been consulted, and agrees to this
extension, provided the subsequent filing dates are similarly extended.
Wherefore, Complainant requests that the briefing schedule in this matter be extended
and modified to the following dates, which are agreed between the parties:
a)
Complainant's Post-Hearing Brief to be filed by February
20, 2009;
b)
Respondent's Post-Hearing Brief to be filed by April 6, 2009;
c)
Complainant's Reply Brief to be filed by April 20, 2009.
