That Jack
Campbell is the current
owner
and
operator
(“Respondent”)
of
a facility
located at 291 County
Road
30E
(lots 15, 16, 23, 24,
58
&59), southwest
of Norris
City,
White
County,
Illinois. The property is
commonly known
to the Illinois
Environmental
Protection Agency
as
Gossett/Campbell,
Jack.
2.
That said
facility is an
open dump
operating without
an Illinois
Environmental
Protection
Agency Operating
Permit and is
designated with
Site
Code No.
1938075005.
3.
That Respondent
has owned and
operated
said
facility at
all
times
pertinent
hereto.
4.
That on January 7,
2009,
Robert
Mileur of
the Illinois Environmental
Protection
Agency’s
(“Illinois EPA”)
Marion Regional
Office
inspected the
above-described
facility. A copy
of
his
inspection report setting
forth
the
results of said inspection
is attached
hereto and
made a
part
hereof.

Based
upon direct
observations
made
by
Robert Mileur during
the
course of
his
January
7,
2009 inspection
of the
above-named
facility, the Illinois
Environmental
Protection
Agency
has
determined
that Respondent
has violated the
Illinois
Environmental
Protection
Act (hereinafter,
the
“Act”)
as follows:
(1)
That Respondent
caused
or allowed
the
open
dumping of waste in
a
manner
resulting
in litter, a violation
of
Section 21(p)(1)
of the
Act,
415 ILCS
5121(p)(1)
(2006).
(2)
That
Respondent
caused or allowed
the open
dumping of
waste in
a manner
resulting
in Deposition
of General
Construction or Demolition
Debris:
or
Clean
Construction
or Demolition
Debris
a
violation of Section
21 (p)(7)
of
the Act,
415
ILCS 5/21
(p)(7) (2006).
CIVIL PENALTY
Pursuant to Section
42(b)(4-5)
of the Act,
415
ILCS 5/42(b)(4-5)
(2006),
Respondent
is
subject to a
civil penalty
of One Thousand Five
Hundred
Dollars ($1,500.00)
for
each
of the
violations identified above,
fora total
of Three
Thousand
Dollars
($3,000.00).
If
Respondentelects
not to
petition
the Illinois
Pollution Control
Board, the statutory
civil penalty
specified
above
shall
be
due and
payable
no later than
March 15, 2009,
unless otherwise
provided
by order of the
Illinois
Pollution
Control
Board.
If
Respondent
elects to
contest this
Administrative
Citation
by petitioning
the
Illinois
Pollution
Control Board in accordance

adjudicatory

costs shall be
assessed
in addition to
the One Thousand
Five
Hundred
Dollar ($1,500.00)
statutory civil
penalty for
each
violation.
Pursuant
to Section 31.1 (d)(1)
of the Act, 415

(d)(1) (2006),
if Respondent
fails
to
petition
or elect not to petition
the Illinois
Pollution
Control Board
for review of this
Administrative
Citation
within
thirty-five

days of the date
of service, the
Illinois
Pollution
Control Board
shall
adopt a final
order,
which
shall include
this
Administrative
Citation and findings
of
violation
as
alleged herein,
and shall
impose
the statutory
civil penalty
specified above.
When payment
is
made,
Respondent’s
check
shall
be made payable
to the
Illinois
Environmental
Protection
Trust
Fund
and mailed
to the attention
of Fiscal Services,
Illinois
Environmental
Protection Agency,

Respondent

This inspection
was conducted in
accordance with
Sections 4(c) and
4(d) of the
Illinois
Environmental
Protection
Act: 415 ILCS 5/4(c)
& 4(d).
The
purpose
of this
inspection
was to determine
compliance
with
the
Illinois Environmental
Protection Act
and
35 Ill. Adm.
Code,
Subtitle
G: Waste
Disposal
Rules and Regulations
of the Illinois
Pollution Control
Board.
The inspection
was a follow
up inspection
and consisted of walking
the site and taking
photographs.
Inspection Findings
We arrived at the
sitelocated
southwest of Norris
City in White county
at
around
12:15pm.
We found
the
site unoccupied
at the
time of the inspection.
Upon arrival I
observed
that
much
of the
open dumping that ws
originally
at the site still remains.
The
material
is spread
over
approximately
two acres
and consisted of
pieces of metal, old
propane
bottles,
an old tractor,
tires, mobile home
remains, an old
tow
truck, tires, and
general
litter. The
site and
material
is all overgrown
with
weeds
and is not
being
protected with any
inCnded future
use. The tire
that ‘ei found at the
site were being
stored
unprotected
and
capable
of holding water. There
are nice
kept homes in the
neighbothood
dthe site is a blight
dn the surrounding
properties. Mr.
Cmpbe1l did
send receipts forsome
of the clean-up
but
the
last receipt received
was on June 15, 2006.
There still remains
around
80 cubic yards
of material. The
site appears to
be abandoned
but
a check of the White
County
Assesors
office
reveals that Mr. Campbell
is still
paying
taxes on the
property.
We completed
the inspection
at around 12:30pm.
