HEARING OFFICER ORDER
On February 3, 2009, the parties participated in separate telephone status
conferences with the hearing officer. Petitioner is reviewing test results, and the parties
will meet to discuss the possibility of settlement. Petitioner agreed to file a deadline
waiver to August 20, 2009 within the next seven days.
The parties are directed to participate in a telephone status conference with the
hearing officer at 9:30 a.m. on April 8, 2009. The status conference shall be initiated by
the petitioner.
The decision deadline for this case is May 21, 2009.
