HEARING OFFICER ORDER
On January 29, 2009, all parties participated in a telephonic status conference with
the hearing officer. The parties represented that settlement discussions continue,
however, the complainant requested a hearing date. It was agreed by all parties the a
hearing in the above-captioned matter will be scheduled for September 22 and 23, 2009.
The respondent also represented that it may retain an expert. The parties were
directed to discuss a discovery schedule as to the possible expert and submit the proposed
schedule to the hearing officer.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on March 26, 2009, at 11:30 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
