HEARING OFFICER ORDER
On January 8, 2009, all parties participated in a telephonic status conference with
the hearing officer. The respondent represented that compliance demonstration issues
remain and is attempting to schedule a meeting with the Illinois Environmental protection
Agency in its attempt to resolve them. The complainant represented that the parties
appear to be at an impasse and requests that the above-captioned matter move forward.
The parties were directed to submit a revised discovery schedule on or before
January 16, 2009. To date, it has not been submitted.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on March 12, 2009, at 11:30 a.m. The
telephonic status conference must be initiated by the complainant, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties must
be prepared to discuss the status of the above-captioned matter and their readiness for
hearing.
