HEARING OFFICER ORDER
On January 22, 2009, the petitioner informed the hearing officer that the parties
have reached a negotiated resolution and are in the process of implementing the
resolution. Meetings and discussions continue. Once a new permit is issued, the
petitioner anticipates that it will file a motion to voluntarily dismiss the above appeal. The
petitioner represented that it will file an additional 60-day waiver of the statutory decision
deadline.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on March 19, 2009, at 11:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties must
be prepared to discuss the status of the above-captioned matter and their readiness for
hearing. If, however, a motion to dismiss is filed prior to the next status conference, the
conference will be cancelled without further notice.
