HEARING OFFICER ORDER
On January 15, 2009, a telephonic status conference was held. It was represented
the Third-Party complainant and respondents will enter into a settlement and the Third-
Party complainant will then file a voluntary motion to dismiss the Third-Party complaint
in the near future.
Once the Third-Party motion to voluntarily dismiss is filed, it is anticipated that
the complainant and respondents will file a stipulation and proposal for settlement
(stipulation). It is noted that Felker’s answer is due to be filed on or before February 6,
2009.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on February 19, 2009, at 11:00 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing. If,

however, a stipulation is filed prior to the next status conference, the conference will be
cancelled without further order.
