HEARING OFFICER ORDER
On January 6, 2009, all parties participated in a telephonic pre-hearing conference
with the hearing officer. Discussions centered on petitioner’s motion to substitute written
testimony that was originally filed on January 2, 2009. Petitioner represents that the
substituted written testimony corrected minor typographical errors. The respondent has
no objections to respondent’s motion. The petitioner’s motion is granted.
The petitioner represented that it will present four witnesses at the hearing
scheduled for January 13, 2009. The respondent represented that it will most likely have
no witnesses.
