    HEARING OFFICER ORDER
    On July 22, 2008, the parties participated in a telephone status conference with the
    hearing officer. At that time, it appeared unlikely that USEPA would act on the permit before
    the end of the year, so the hearing officer agreed to set the next status conference for 2009.
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on January 27, 2009. The telephone status conference will be initiated by
    the petitioner.
    Petitioner filed an open waiver of the statutory decision deadline in this matter.
    IT IS SO ORDERED.
