pursuant
to

Section
101.308
and
hereby
waives
the
statutory
decision
deadline
in this
matter.
In
support
thereof,
Joliet
states
as
follows:
1.
On October
17,
2008,
Joliet
timely
submitted
its permit
appeal
to
the
Board
to
review
a September
12,
2008
determination
of
the
Illinois
Environmental
Protection
Agency
(“IEPA”)
regarding
Joliet’s
application
of sewage
sludge
from
its
wastewater
treatment
operations.
2.
Pursuant
to
Section
40(a)(2)
of
the
Act
(415
ILCS
5/40(a)(2)(2007))
the
Board
has
120
days
after
the
date
on
which
it
received
the
petition
for
appeal
to
make
a
decision.
Therefore,
the
120
day
period
expires
on February
16,
2009.
3.
A
hearing
has been
scheduled
in
this
matter
for
January
13,
2009
at the
Village
of
Bolingbrook board
room.
4.
Joliet’s
wishes
to
waive
the
Board’s
statutory
decision
deadline
in
this
matter
until
April
3, 2009.
