Letter from the Chairman
Generally, with this letter I highlight some of the Board’s work performed over the
prior month; however, this month we welcome a new Board Member, Dr. Shundar
Lin and honor the service of departing Board Member, Nicholas J. Melas.
We welcome the appointment, effective November 3, 2008, of new Board Member,
Dr. Shundar Lin. Dr. Lin comes to the Board after serving nearly 35 years as
Senior Professional Scientist at the Illinois State Water Survey. Throughout his
career, he has gained extensive research experience in microbiology, lake and
stream water quality, wastewater management, stream sanitation, and environmental
engineering. Dr. Lin earned a B.S. in Civil Engineering from National Taiwan
University, a M.S. in Sanitary Engineering from the University of Cincinnati, and a
Ph.D. in Sanitary Engineering from Syracuse University.
Meanwhile we bid farewell to Board Member Melas who was first appointed to the
Board in May 1998 and reappointed in 2000, 2003, and 2005. His last day at the
Board was November 30. Member Melas distinguished public service career over
six decades has included 30 years as Commissioner of the Metropolitan Water Reclamation District of Greater
Chicago and President of its Board for the last 18 of those years. Member Melas has a deep involvement with a
wide range of professional, environmental, religious, and community service organizations. From the University of
Chicago, he earned an M.B.A. from the Graduate School of Business as well as a B.S. in Chemistry.
During his Board tenure, Member Melas’ commitment and expertise contributed immeasurably to the Board’s work.
With all the time and knowledge he has generously committed to our work, he has earned the appreciation, respect,
and friendship of many persons, particularly his fellow Board members and the Board’s staff. He has our fond best
wishes for success and happiness in all of his future endeavors.

Rule Update
Board Adopts First Notice Proposal Without Comment on Merits in Amendments to 35 Ill. Adm. Code 225:
Control of Emissions from Large Combustion Sources (Mercury Monitoring), R09-10
On November 5, 2008, the Illinois Pollution Control Board accepted for hearing the October 3, 2008 proposal from
the Illinois Environmental Protection Agency (IEPA) to amend Part 225 of the Board’s air pollution regulations.
IEPA’s proposal seeks to recreate certain monitoring provisions of the federal Clean Air Mercury Rule (CAMR),
which was recently vacated by a federal court. The proposed rule was docketed as In the Matter of: Amendments
to 35 Ill. Adm. Code 225: Control of Emissions from Large Combustion Sources (Mercury Monitoring), R09-10.
In its November 5, 2008 order, the Board also granted the IEPA’s motion for expedited review of the proposal. The
Board directed the Clerk to cause publication of the proposal in the
Illinois Register
for first notice without
commenting on its substantive merits.
The IEPA, in its statement of reasons supporting the proposal, states that CAMR provided that states must require
electric generating units “to comply with the monitoring, recordkeeping, and reporting provisions of Part 75 of the
Code of Federal Regulations
with regard to monitoring emissions of mercury to the atmosphere.” The current
Illinois mercury rule specifically requires compliance with 40 C.F.R. Part 75. However, the United States Court of
Appeals for the District of Columbia recently vacated CAMR, removing the monitoring provisions of that rule, and
creating the need to amend Part 225 “to recreate certain monitoring provisions of the federal rule.” The IEPA
claims that “[t]he substance of Part 225 is unchanged as those regulations will continue to address the control of
mercury emissions from coal-fired electric generating units beginning in July 2009.”
Hearings are scheduled for:
December 17, 2008, at 9:00 am at the IEPA Office Building, Training Room 1214 West, 1021 N. Grand Avenue
East, North Entrance, Springfield, Illinois; and
January 13, 2009, 11:00 am in Room 11-512 (Illinois Pollution Control Board Videoconference Room) at 100 W.
Randolph Street, James R. Thompson Center, Chicago, Illinois.
Interested persons should consult the November 7, 2008 hearing officer order which sets deadlines for the pre-filing
of testimony and discusses other hearing procedures.
Publication of these proposed amendments in the
Illinois Register
will begin a 45-day public comment period,
during which anyone may file a public comment with the Board. The Board encourages persons to file public
comments on these proposed amendments. The docket number for this rulemaking, R09-10, should be indicated on
the public comment.

Board Adopts Rules “Identical in Substance” to Federal Rules in Wastewater Pretreatment Update, USEPA
Amendments (January 1, 2007 through June 30, 2007) R08-5
On November 20, 2008, the Board adopted final rules in Wastewater Pretreatment Update, USEPA Amendments
(January 1, 2007 through June 30, 2007 and June 3, 2008), R08-5, amending Illinois regulations that are “identical
in substance” to wastewater pretreatment regulations adopted by the United States Environmental Protection
Agency (USEPA). The amendments incorporate into the Illinois wastewater pretreatment amendments in response
to one USEPA action that occurred during the identical-in-substance update period of January 1, 2007 through
June 30, 2007. On March 12, 2007, USEPA adopted amendments relating to analytical methods approved under
the wastewater pretreatment and drinking water programs.
The R08-5 docket includes federal pretreatment amendments that USEPA adopted in the consecutive time period
January 1, 2007 through June 30, 2007, and amends the Board’s rules at 35 Ill. Adm. Code Parts 307 and 310.
March 12, 2007 (at 72 Fed. Reg. 11200)
USEPA modified the testing procedures approved for sampling an analysis in programs established under the Clean
Water Act (CWA) and SDWA. The wastewater pretreatment rules are established under the CWA, and the Primary
Drinking Water Regulations are established under SDWA. The amendments updated the versions allowed for
existing methods and approved new methods for use. The Board adopted this proposal for public comment on
August 7, 2008, as part of consolidated docket R08-5, R08-7; and R08-13. R08-5 was separated from the other
dockets September 4, 2008. The R08-5 proposal was published in the
Illinois Register
at 32 Ill. Reg. 14032 (Part
307), 14054 (Part 310) (August 29, 2008). Only one relevant public comment was received during the public
comment period that ran from August 29, 2008 through October 13, 2008. The adopted amendments are
substantively unchanged from the proposal.
The Board will file the adopted amendments with the Office of the Secretary of State (SOS) and submit them for
publication in the
Illinois Register
. The rules are effective upon filing with the SOS.

Board Adopts Final Rules in RCRA Subtitle Update USEPA Amendments (January 1, 2008 through June 30,
2008) (R09-3)
On November 20, 2008, the Board adopted final rules in RCRA Subtitle Update USEPA Amendments (January 1,
2008 through June 30, 2008) (R09-3), updating the Illinois hazardous waste regulations to incorporate revisions to
the federal regulations. The United States Environmental Protection Agency (USEPA) adopted the federal
hazardous waste amendments that prompted this update during the time periods of January 1, 2008 through June 30,
2008. This rulemaking amends 35 Ill. Adm. Code 721, 721, 724, 725, 726, and 728. The docket also includes
amendments responding to comments submitted by USEPA after the conclusion of the prior update docket: RCRA
Subtitle C Update, USEPA Amendments (March 5, 2005, September 8, 2005, January 1, 2006 through June 30,
2006) R07-5, RCRA Subtitle C Update (July 1, 2006 through December 31, 2006), R07-14 (June 5, 2008)
(consolidated).)
USEPA amended the federal hazardous waste regulations three times during the period January 1, 2008 through
June 30, 2008, as follows:
January 2, 2008 (at 73 Fed. Reg 57)
USEPA broadened an existing exclusion from the definition of solid waste for oil-bearing secondary materials that
are reinserted into the refining process. The exclusion now embraces the gasification of oil-bearing secondary
materials when processed in a gasification system at a refinery for production of synthesis gas.

The Board has incorporated the limited federal amendments into the Illinois rules. As required, the Board added a
new definition of “gasification” to 40 C.F.R. 720.110 and amended the existing exclusion from the definition of
solid waste in 35 Ill. Adm. Code 721.104.
April 8, 2008 (at 73 Fed. Reg. 18970)
USEPA amended the October 12, 2005 (70 Fed. Reg. 59402) Hazardous Waste Combustor Rule. The body of
hazardous waste combustor rules is codified as an air rule, at subpart EEE of 40 C.F.R 63, and the major portion of
the April 8, 2008 amendments involved subpart EEE. The HWM facility standards of 40 C.F.R. 264 through 266
include limited segments that describe the interplay between the hazardous waste combustor rule and the HWM
facility standards. The April 8, 2008 amendments included limited amendments to the HWM facility standards.
The Board incorporated the federal hazardous waste combustor rule amendments into the Illinois rules. As
required, the Board updated the incorporation of subpart EEE of 40 C.F.R. 63 by reference in 35 Ill. Adm. Code
720.111 to include the amendments. The Board was also required to amend 35 Ill. Code 724.440 and 726.200.
June 4, 2008 (at 73 Fed. Reg. 31756)
USEPA amended the F019 hazardous waste listing to exempt wastewater treatment sludges from zinc phosphating
when generated by a motor vehicle manufacturing process, subject to limitations. F019 waste is wastewater
treatment sludge from the chemical conversion of coating of aluminum.
The Board amended the F019 waste listing in 35 Ill. Adm. Code 721.131 to correspond with the federal
amendments. The amendments involved reliance on non-hazardous waste landfill requirements.
The Board will delay the filing of the adopted amendments with the Office of the Secretary of State (SOS) for 30
days, specifically to allow final USEPA review of the amendments. The Board requested that USEPA comment on
the Board’s handling of the June 4, 2008 exception from the F019 hazardous waste listing. The Board has
significantly altered the USEPA language of the exception, in order to tailor it to Illinois-specific regulation of non-
hazardous waste landfills. The Board may have to make changes to the adopted rules prior to filing, to respond to
USEPA comments.
The adopted rules are effective upon filing with the SOS. The due date for final Board action to adopt any
amendments and cause them to be filed and become effective is January 2, 2009.
