HEARING OFFICER ORDER
On December 8, 2008, all parties participated in a telephonic status conference
with the hearing officer. Discussions centered on whether a hearing is required to be
held. Petitioners have waived hearing pursuant to Section 104.204 of the Board’s
procedural rules. Respondent, nor any other person filed a request for hearing pursuant
to Section 104.216 and 104.224 of the Board’s procedural rules.
To that end, the parties represented that they are awaiting the Board’s decision
regarding petitioners’ petition for variance. It is noted that currently, the statutory
decision deadline is January 29, 2009. The Board meeting immediately before the
decision deadline is scheduled for January 22, 2009.
