    County, Illinois.
    The property
    is commonly
    known to the Illinois
    Environmental
    Protection
    Agency
    as
    St.
    Francisville/Codgill,
    Terry.

    That
    said
    facility is an
    open
    dump operating
    without
    an
    Illinois
    Environmental
    Protection
    Agency Operating Permit
    and is
    designated
    Mth
    Site Code No.
    1010255005.

    That
    Respondent
    has owned
    said facility at all times
    pertinent hereto.

    That
    on October 17, 2008,
    Gerald Steele
    of the Illinois
    Environmental
    Protection
    Agency’s
    (“Illinois EPA”)
    Marion Regional

    inspected
    the
    above-described
    facility. A

    report

    forth
    the results
    of said inspection

    manner
    resulting

    a violation
    of

    21(p)(1)
    of the
    Act,

    That
    Respondent
    caused

    allowed
    the
    open dumping
    of waste
    in
    a
    manner
    resulting
    in
    open
    burning,
    a
    violation
    of
    Section
    21(p)(3)
    of the Act,

    That
    Respondent
    caused
    or allowed
    the
    open
    dumping
    of
    waste in
    a
    manner
    resulting
    in Deposition
    of General
    Construction
    or
    Demolition

    violation
    of Section
    21 (p)(7) of
    the

    CIVIL
    PENALTY
    Pursuant
    to Section
    42(b)(4-5)
    of the
    Act,

    Respondent

    This
    site
    was
    visited
    as
    the result of a complaint.
    Bob Gher,
    Ambraw
    Valley
    Solid
    Waste,
    accompanied
    me on this
    inspection.
    The property
    is located on the southeast
    corner of Eighth and
    Johnson Streets
    in
    St. Francisville. The lot
    measures about
    50 yards.
    A home is located on
    the lot. According to
    County
    records,
    the home
    covers about 1100
    sq.
    feet.
    A
    majority of the rest of
    the property contained
    wastes,
    including metal
    wastes. Other
    wastes
    included
    construction/demolition
    debris,
    and
    tires. Indications
    of
    open
    burning were
    also seen. The house
    appeared abandoned.
    The
    newspaper
    box contained
    several
    newspapers. The
    newest one was
    from
    October
    18, 2007. A trailer
    containing
    a metal
    shed was parked
    on
    the
    west
    central
    part of
    the site. It had a valid
    registration sticker.
    No other vehicle
    or trailer on the
    site
    was observed with
    valid registration.
    Due
    to the tall grass
    under
    and adjacent
    to this trailer, it
    did not
    appear to
    have
    been moved for some
    time. Items
    were thrown haphazardly
    throughout the property
    with
    very
    little
    resemblance
    to order observed.
    A
    boat was
    seen on the north side
    of the house. Fresh and
    decomposing
    leaf litter upside
    the boat was thick
    enough
    that
    a maple tree sampling
    was growing inside
    of
    it.
    Evidence of open
    burning
    of
    wood and tires was seen
    on the north central
    part
    of the site.
    It
    measured approximately
    4
    yds. x 3 yds.
    Indicators that the
    waste
    had
    been
    burned here
    (charred ground
    underneath, concentric
    rings
    of wire
    from the tire seals)
    was seen. All of
    the metal wastes were
    exposed
    to the elements.
    Weeds and
    brush were growing
    immediately
    adjacent, and some times
    through the
    wastes.
    Windows
    were broken, or doors
    were open or missing
    on the vehicle seen
    here. A
    dead tree had
    fallen
    on
    some
    of the metal waste.
    Vehicles
    were seen almost totally
    overgrown by vegetation.
    Trees

    were observed
    growing
    through
    the wastes.
    The following
    conditions, which constitute
    open
    dumping,
    were
    observed:

    Evidence
    of onsite open burning
    was
    seen
    in the
    north central
    part of the site.
    Line
    5. Cause or allow open
    dumping: Metal
    wastes, tires
    and other debris were
    scattered
    covering
    most
    of this piece of
    property. The materials,
    including
    vehicle
    interiors,
    were exposed
    to the
    elements.
    Weeds, tall grass,
    and trees were growing
    adjacent
    to,
    or in, the accumulations
    of metal
    waste.
    The
    materials were not
    in use, not usable in
    their
    current condition,
    and
    were not being
    protected
    for
    future
    use. These
    materials were
    not being
    removed
    on
    a regular basis,
    as some items
    were nearly
    overgrown
    by
    vegetation. Vehicles and
    trailers
    were
    seen with their tires
    sinking into the
    dirt; they had
    been there
    that
    long.

    Conducting
    a
    waste disposal
    operation without
    a permit,
    disposing
    of
    wastes
    at a
    site
    that
    does not
    meet Act requirements.
    Failure
    to submit
    a permit application:
    Wastes
    have
    been
    brought
    in
    from
    off-site. These included
    highway
    warning
    markers, commercial
    shelving,
    oil field
    pipe and
    military
    shipping
    containers.
    A review of Regional
    records
    does not show that
    a permit was
    applied for
    nor
    issued.

    Open dumping
    allowing
    litter
    and open burning:
    The metal wastes
    at this location
    are
    very
    unsightly.
    The
    materials
    are not in use,
    useable in their
    current condition and
    not
    being protected
    for
    future
    use.
    They include vehicles,
    shipping containers,
    pipe,
    shelving,
    motors, appliances,
    sinks and
    other
    wastes.
    Open
    burning had occurred
    on
    the north central
    part of the site.
    The ground was
    charred
    underneath
    the
    ash. Concentric
    tire beads
    were
    observed
    had been burned.

    The
    only
    people
    wespoke
    to
    during
    this
    inspection
    were
    neighbors,
    who
    talked
    of
    how
    unsightly
    thesite
    was.
    Records

    Lawrence
    County
    Courthouse
