HEARING OFFICER ORDER
On December 1, 2008, the parties participated in a telephone status conference
with the hearing officer. On November 17, 2008, petitioner filed a motion for summary
judgment. The parties agree that respondent’s deadline to respond is December 15, 2008.
Petitioner is granted leave to reply by December 29, 2008. Additionally, petitioner
agreed to file a 40-day deadline waiver within the next seven days.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:00 a.m. on January 7, 2009. The status conference shall be initiated
by the petitioner.
The decision deadline is currently March 19, 2009.
