HEARING OFFICER ORDER
On December 1, 2008, all parties participated in a telephonic status conference
with the hearing officer. The complainant represented that the respondents are not
eligible for a penalty reduction and that it appears that settlement is not likely. The
parties were directed to submit a proposed discovery schedule on or before December 12,
2008.
The respondents were reminded that their answers are due on or before December 19,
2008. The respondents represented that they do not intend to retain an attorney as
required by Section 101. 400 (2) of the Board’s procedural rules.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on January 29, 2009, at 10:30 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
