HEARING OFFICER ORDER
On November 13, 2008, a telephonic status conference was held. It was
represented that a draft stipulation and proposal for settlement between the complainant
and respondents, Felker Pharmacy, Inc. (Felker), and Rod Bennett Construction, Inc.
(Bennett) is being circulated for review. It was also represented that settlement
discussions continue with Bennett and the Third-Party respondents continue. By
agreement, Felker’s answer is now due to be filed on or before February 6, 2009.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on January 15, 2009, 10:45 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing. If,
however, stipulations are filed as to all parties prior to the next status conference, the
conference will be cancelled without further notice.
