That Allied
Waste
Inc. is the permitted
owner
and
operator
of a facility
located
at
825
Willard
Street, Greenville,
Bond
County,
Illinois.
2.
That
said
facility
is
a sanitary
landfill, operating
under
Illinois
Environmental
Protection
Agency
Permit
No. 1993-1
88-LF,
and is designated
with
Site
Code
No.
0050055055.
The
facility is
commonly
known
to the Illinois
Environmental
Protection
Agency
as
Greenville/Bond County Landfill.
3.
That
Respondent
has owned
and operated
said facility
at
all
times
pertinent
hereto.
4.
That on September18,
2008,
Kendall
Couch of the
Illinois Environmental
Protection
Agency’s
Collinsville
Regional
Office
inspected
the
above-referenced
facility.
A copy
of
his
inspection
report
setting
forth the
results
of said inspection
is
attached
hereto
and made
a part
hereof.

Based
upon
direct
observations
made
by
Kendall
Couch
during
the
course
of his
September
18,
2008 inspection
of
the
above-referenced
facility,
the
Illinois
Environmental
Protection
Agency
has determined that Respondent
violated
the Illinois
Environmental
Protection
Act
(hereinafter,
the
“Act”)
as
follows:
(1) That
Respondent
conducted
a sanitary
landfill
in
a
mannerwhich
resulted
in
uncovered
refuse
remaining
from
the
previous
operating
day
or at the
conclusion
of
any
operating
day,
a
violation
of
Section
21
(o)(5)
of
the
Act, 415
ILCS
5/21
(o)(5)
(2006).
CIVIL PENALTY
Pursuant
to Section
42(b)(4)
of
the Act,
415 ILCS
5/42(b)(4)
(2006),
Respondent
is
subject
to
a
civil
penalty
of
Five
Hundred
Dollars
($500.00)
for
each
of the
violations
identified
above,
for
a
total
of Five
Hundred
Dollars
($500.00).
If Respondent
elects
not
to
petition
the
Illinois
Pollution
Control
Board,
the
statutory
civil
penalty
specified
above
shall
be due
and
payable
no later
than
November
30,
2008,
unless
otherwise
provided
by
order
of the Illinois
Pollution
Control
Board.
If
Respondent
elects
to
contest
this Administrative
Citation
by
petitioning
the
Illinois
Pollution
Control
Board
in
accordance
with
Section
31.1
of the
Act,
415
ILCS
5/31.1(2006),
and if
the
Illinois
Pollution
Control
Board
issues
a
finding
of
violation
as
alleged
herein,
after
an
adjudicatory
hearing,

be assessed

be assessed
in addition
to the

Narrative
General
Remarks
On September
29, 2008,
I went to Greenville,
Illinois
to conduct
an
inspection
at
this site.
This site is
a
permitted 811 landfill
operating under
permit
numberl
993-1 88-LF Mod
#34.
I started
this inspection
at
4:45
am. Fog
with no
light
and the temperature
was
500
Fahrenheit
when
I arrived.
The weather
was sunny, dry and the
temperature was
550
Fahrenheit
after the sun
came up. Scale
house
operator,
Sharron
Hughes, chief
operator,
Greg
Dolliger and landfill
manager Lee
Wheat
were
present during this inspection.
Inspection
When
I
arrived
I met with Greg
Dolliger. Mr.
Dolliger was at
the scale waiting to
clock-
in. Mr. Dolliger
and I then went
to the open
face
of
this
site.
When we arrived
I noticed
the new methane
flare was
not lit.
Mr.
Dolliger
said
that
he
would check the
flare as soon
as time permitted
and
that it would
go out from time
to time automatically
via system
controls.
We
then
arrived
at the
open
face. I observed
the open
face
covered with
a tarp. I
walked
around the
circumference
of the tarp with
a flashlight. The
tarp appeared
adequately
anchored
and appeared
to be structurally
sound. Exposed
refuse was observed
just
outside the
tarp.
Four
pictures
(#1-4)
were
taken
documenting the ADC
observed.
A
considerable
amount of
waste was also
observed along the
entrance to
the
open
face.
Picture
#5
documents
the waste observed
throughout
the
entrance to
the
open face. Mr.
Dolliger
explained
that
the heavy
rains experience
during Hurricane
Ike’s travels through
the
Greenville
area caused
the
compactor to
track this waste
away
from the open face.
Mr. Dolliger
stated that his
facility had
been
working hard
to keep the waste from
tracking
outside the face
boundary
but
the
water saturated
face base and entrance,
made
the
waste very difficult
to contain.
After this initial
face inspection,
Mr. Dolliger
and I went back
to the scalehouse were
he
clocked-in
and began his normal
start-up operations.
I then
went into Greenville
to
purchase
a cup of coffee while
the start-up
operations
were taking place. When
I returned
I
went to the service garage
on
the
southern
edge
of this site and watch
over the landfill
start-up operations.
The methane
gas flare
was
ignited and appeared
to be functioning
properly.
While
waiting
at
the
garage,
I inspected
the combustible
gas monitor located
within. This
monitor appeared
to be functional
and in good
condition. Lee Wheat,
Landfill
Manager then arrived
and
we discussed
general
operations and the
extreme
weather conditions
experienced
during
Hurricane Ike’s visit
to his landfill. Mr.
Wheat
stated
that operations
were normal except
for the recent
weather.

I then
went to the open face
to observe normal operations.
A
new tarp with
dimensions
96X1 00 feet
was
observed
just to the
east of the open face.
Rich Komar
and
Mr. Dolliger
were operating
the
compactor
and dozer during
this inspection.
One earth mover,
track
hoe and
additional
compactor were idle
at this time. Flood
lighting and wind
fencing
were located
on the northeastern and
northwestern end
of the open face
respectively.
At
7:36am,
a Vandalia Correctional
Center roll-off
dumpster was
observed dumping
its load.
The
waste unloaded appeared
normal.
Several other
loads of
residential trash
and an
Allied
Waste
roll-off dumpster
were observed
dumping. All waste
appeared normal.
While
observing
the unloading
of waste I
notice some standing
water
along
the
southeastern
edge of
the landfill.
After
observing the open
face operations,
I walked the top
of the
northern
portion
of the
landfill. I inspected
each gas collection
well as well
as slope
configuration
and
intermediate
cover. All gas wells appeared
to be
working
properly.
A small amount
of
hissing was
heard around the south
central well
head.
This well head
would
be
later
discussed
with Mr. Dolliger.
The side slope on the
western
edge
of the landfill
had
several erosion
ditches
with exposed
refuse
lying within the
erosion ditches
(Picture #13).
These
erosion ditches were
located towards the
southern end
of the
permitted
landfill
footprint
and contained several
small leachate
seeps. No leachate
was observed
leaving
the landfill’s
permitted boundary.
The
northern and
eastern slope of the landfill
was in
good
condition
and water
control
berms
had been constructed
to eliminate soil erosion
(Picture
#14).
Overall,
the
northern
portion
of this landfill
was in good condition
and no leachate
seeps
were
observed.
This
portion of
the
landfill
had
been
recently
graded to prepare
for
final
cover
placement.
During
this
walkthrough
of the landfill,
all
gas collection
wells were
inspected and
appeared
to be
operating
correctly.
I then left
the facility to go into
Greenville
for
breakfast.
When
I returned I went around
the outer
landfill
boundary
to
inspect the ground
water
monitoring
wells and
gas probe
wells.
All of
the wells appeared
to be structurally
sound
and
reasonably
accessible.
One well was unlocked
on the western
edge
of
the landfill.
After inspecting
these
wells I went to the leachate
aeration
pond. The
aeration unit was
not
functional during
this inspection. I walked
the
perimeter
of the leachate
pond and it
appeared
structurally
sound. Mr. Dolliger
stated that
the aeration unit
would
be repaired
as
soon as
possible.

I then met
again with
Mr. Dolliger.
We
discussed
my
observations
during
this
inspection.
I explained
the
need
to control
storm
water
to
prevent ponding,
keep
all
well heads
locked,
eliminate
exposed
refuse
and the need
to inspect
the new
gas
wells for
leaks. Mr.
Dolliger
stated that
he was working
on
the
ponding
water and
exposed
refuse
cause by
the
extreme
recent weather
and would
keep
an eye
on the gas
wells
for structural
integrity.
The
well
head was
locked
during
this
inspection.
I then
went to
the
scalehouse
and met
with
Sharron
Hughes.
I
requested
copies of the
daily
tonnage log,
daily special
waste
log
and leachate
discharge
report.
This
documentation
is attached
to
this
report.
The daily
tonnage
log
reports an
average of
1072
tons
per
week.
There
are
approximately
8
different
special waste
streams
being
disposed
at this facility.
Several
special
waste
analysis and
non-special
waste
certifications
were
reviewed
during
this inspection.
Greenville’s
waste water
treatment
sludge,
Carlisle
Syntec’s
composite
solids
and Mallinckrodt’s
acetaminophen
special
waste stream
documentation
was
reviewed
during
this inspection.
The asbestos
map
indicates
that this
facility
is placing the
incoming
asbestos
on the
northwest
end
of
Phase
3b.
The ADC
log
was
reviewed
and appeared
to be in order.
The
weekly
load checking
inspection
log was
also
reviewed
and appeared
to be
in order.
After
reviewing
this
documentation
I
explained
to Ms. Hughes
that I would
need
to
review
several
parts
of the JEPA
Regulations
and
ACT to
confirm
compliance.
This
review
is
ongoing and
will be
accessed
during subsequent
inspections.

this
inspection,
several apparent
violations
of the

Environmental
Protection
Act,
