HEARING OFFICER ORDER
On November 6, 2008, all parties participated in a telephonic status conference with the
hearing officer. The parties were informed that while on the Board’s agenda, the Board has yet
to rule on respondent’s motion to dismiss or the complainant’s amended motion for summary
judgment.
The respondent represented that it anticipates that it will file a motion for leave to file a
response and response to complainant’s amended motion for summary judgment that was filed
on July 30, 2008. Complainant orally objected to any extension of time to file respondent’s
response. If respondent does file a motion for leave to file a response, complainant is reminded
that she has 14 days from the date of service to file her written response to respondent’s motion
for leave.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on December 15, 2008, at 11:00 a.m. The telephonic
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
