HEARING OFFICER ORDER
On November 5, 2008, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that it appears that they have stipulated to all the facts
that were the subject of complainant’s Request to Admit Facts that was filed on October 15,
2008. The hearing in the above-captioned matter is scheduled for December 10 and 11, 2008.
The time and location will be noted in the notice of hearing.
The parties were informed on October 2, 2008, that all pre-hearing motions, including
motions
in limine
, must be filed on or before November 10, 2008, not November 14, 2008, as
was discussed at the November 5, 2008, telephonic status conference. The responses are due to
be filed on or before November 14, 2008. The parties witness list and exhibit list must be filed
on or before November 21, 2008. The mailbox rule does not apply to the aforementioned filings,
and all electronic or approved telefax filings must be received by the Clerk’s office no later than
4:30 p.m. of the due date.
The parties are directed to participate in a telephonic pre-hearing conference with the
hearing officer on December 1, 2008, at 10:30 a.m. Please note the time change. The
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
