HEARING OFFICER ORDER
On October 28, 2008, the complainant informed the hearing officer that the parties have
agreed to extend the complainant’s requirement that it disclose its expert witnesses and reports.
To that end, the discovery schedule is as follows. Complainant must disclose expert witness and
their respective reports on or before November 10, 2008. Depositions of complainant’s expert
witnesses must be completed on or before December 15, 2008. Respondent must disclose expert
witnesses and their respective reports on or before January 19. 2009. Depositions of
respondent’s expert witnesses must be completed on or before February 16, 2009. All discovery,
written and oral, must be completed on or before March 3, 2009. Dispositive motions must be
filed on or before March 3, 2009. Responses to dispositive motions must be filed on or before
April 15, 2009. Hearing dates will be discussed at telephonic status conferences in January or
February, 2009.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 22, 2008, at 11:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
