HEARING OFFICER ORDER
On October 2, 2008,the parties were directed to submit their proposed discovery
schedules on or before October 10, 2008. On October 14, 2008, the respondents filed their
proposed discovery schedule. The respondents represent that the complainants have no
objection to the proposed discovery schedule.
To that end, and after reviewing the respondents proposed discovery schedule, the
discovery schedule is as follows. All written discovery must be served on or before October 31,
2008. All responses to written discovery must be served on or before December 5, 2008. All
oral depositions of fact witnesses (non-expert) must be completed on or before March 5, 2009.
Scheduling for expert witness depositions will be discussed at the November 13, 2008,
telephonic status conference.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on November 13, 2008, at 10:30 a.m. The telephonic
conference must be initiated by the complainants, but each party is nonetheless responsible for
its own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
