    ORDER OF THE BOARD (by N.J. Melas):
    On December 18, 2006, the Illinois Environmental Protection Agency (Agency) timely
    filed an administrative citation against Charles Norman Bartlett (Bartlett).

    5/31.1(c) (2006); 35 Ill. Adm. Code 108.202(c). The administrative citation concerns Bartlett’s
    site located approximately 2.5 miles northeast of Hamburg and north of Irish Hollow Road in
    Calhoun County. The property is known to the Agency as the “Hamburg Pct./Bartlett” site and
    is designated with Site Code No. 0138555004. The Agency alleged that Bartlett violated
    Sections 21(p)(1) and (p)(7) of the Environmental Protection Act (415 ILCS 5/21(p)(1), (p)(7)
    (2006)) by causing or allowing the open dumping of waste in a manner resulting in litter and the
    deposition of general or clean construction or demolition debris at the site.
    On February 1, 2007, the Board accepted for hearing Bartlett’s petition to contest the
    administrative citation. The parties have since participated in a number of telephone status
    conferences with the Board’s hearing officer. The case has not been to hearing. On September
    25, 2008, the Agency filed a motion to voluntarily dismiss the administrative citation. In the
    motion, the Agency states that “[b]ased on newly-discovered circumstances surrounding this
    case, Illinois EPA believes that it is now appropriate to dismiss this Administrative Citation
    against Respondent.” Motion at 1. The Board grants the Agency’s motion, dismisses this case,
    and closes the docket.
