HEARING OFFICER ORDER
On September 23, 2008, petitioner participated in a telephone status conference
with the hearing officer. Respondent did not appear. Petitioner is waiting for test results
at the facility, and the parties continue to discuss the possibility of settlement. At the next
status conference, an additional deadline waiver will be discussed.
The parties are directed to participate in a telephone status conference with the
hearing officer at 10:30 a.m. on November 18, 2008. The status conference shall be
initiated by the petitioner.
The decision deadline for this case is February 19, 2009.
