HEARING OFFICER ORDER
On September 16, 2008, Board issued an order directing the hearing officer to
schedule a telephone status conference with the parties to set deadlines for the filing of
legal briefs. Consistent with the appellate court’s decision, the briefs must address
whether the Illinois Environmental Protection Agency abused its discretion in deciding
not to hold a public hearing concerning the National Pollutant Discharge Elimination
System (NPDES) permit for United States Steel Corporation’s Granite City steelmaking
facility.
The parties are directed to participate in a telephone status conference with the
hearing officer at 11:00 a.m. on October 14, 2008. The status conference shall be
initiated by the petitioner.
