HEARING OFFICER ORDER

On September 10, 2008, by oral motion at hearing, the Illinois Environmental Protection

Agency (IEPA) asked for additional time to prefile questions for Midwest Generation LLC

(Midwest Gen) witnesses, whose testimony was filed on September 8, 2008. IEPA represented

that Midwest Gen did not object and the Environmental Law and Policy Center joined in the

motion. The motion is hereby granted and prefiled questions for the testimony filed on

September 8, 2008 are due October 21, 2008. This extension is for all participants who may

wish to file questions.
