HEARING OFFICER ORDER
On September 4, 2008, all parties participated in a telephonic status conference
with the hearing officer. The complainant represented that after review of the financial
documents forwarded to it by the respondents, the respondents at this time do not qualify
for a penalty reduction. The respondent, however, has recently revealed to the
complainant that other mitigation factors may qualify and that it will forward additional
documents to the complainant for its review. It was agreed that respondent’s answer or
other pleading is now due on or before October 24, 2008.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on October 9, 2008, at 11:00 a.m. The
telephonic conference must be initiated by the complainant, but each party is nonetheless
responsible for its own appearance. At the conference the parties must be prepared to
discuss the status of the above-captioned matter and their readiness for hearing.
