HEARING OFFICER ORDER
On August 28,, 2008, all parties participated in a telephonic status conference
with the hearing officer. At issue during the conference were printouts that the Illinois
Environmental Protection Agency (Agency) produced at the hearing on August 20, 2008.
The Agency also filed supplemental printouts on August 27, 2008, that wee also
discussed at the conference. The petitioner represented that due to the lateness of the
filing, they have been unable to review and discuss with the Agency the recent filing.
The parties were directed to discuss the printouts prior to the next status conference.
The parties are reminded that the hearing in the above-captioned matter, held
August 20, 2008, was continued on record to September 5, 2008, if needed.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on September 2, 2008, at 1:30 p.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the conference, the parties must be
prepared to discuss the status of the above-captioned matter and whether the hearing
scheduled for September 5, 2008, needs to go forward.
